A notary public is tasked with verifying the authenticity of your most important transactions. Their consent is often the final step in establishing power of attorney, closing on a home, or opening a retirement account.

So what is a notary public? Who are the people that stamp your documents, and what does it take to earn their (literal) seal of approval?

What Does a Notary Public Do?
A notary public is a public official appointed by a state government to help deter fraud. Notary publics witness the signing of important documents and verify the identity of the signer(s), their willingness to sign the documents, and their awareness of the contents of the document or transaction.

What is a Notary?

A notary, also called a notary public, is a person authorized to witness the signing of legal documents, usually concerned with deeds, estates, licenses, power of attorney, affidavits, and trusts. As a publicly commissioned official, a notary is tasked with verifying the authenticity of documents, and they serve as impartial witnesses when signing legal documents.

Legal documents are notarized to ensure that transactions are properly executed and to deter fraud. When verifying the authenticity of documents, notaries are required to identify signatories to a document to w**d out impostors and to ensure that parties enter into an agreement willingly and knowingly.

What is the importance of a Notary Public?

-Notaries prevent identity theft and forgery.

-Notaries protect property owners from having imposters forge their names on property deeds and unlawfully sell the property. In other words, they ensure that only true owners can sell property, which isn't the case in many countries.

-Notaries protect elderly people from having their signatures forged on powers of attorney, and thereby prevent fraudsters from stealing from their bank accounts or buying real estate in their names.

-Notaries ensure that title companies can trust that deeds are authentic and not fraudulent.

-Notaries are essential for our economy and society, enabling people to trust each other.

The difference between an Acknowledgment and Jurat. A Notary public can not advice clients on which one to use, all we can do is explain what each one is and then it is the client’s responsibility to choose.

Acknowledgment - The purpose of an acknowledgment is for the signer, whose identity has been verified, to declare to a Notary that he or she has willingly signed a document.

Jurat - The purpose of a jurat (also known in some states as a “verification upon oath or affirmation”) is for a signer to swear to or affirm the truthfulness of the contents of a document to a Notary.

Most documents already have either the acknowledgment or jurat attached but it’s good to know the difference in case you have to add either one to the document that needs notarization.
