The legal age for drinking alcoholic beverages in California is 21 years old. If you are convicted of a number of alcohol related crimes and you are under 21 you can lose your privilege to drive for one year. Some of the common crimes for which you can lose your license are any drug or alcohol related crimes. The list includes minors in possession of: alcohol (even a closed container of alcohol while in a vehicle), ma*****na (although ma*****na possession of under an ounce is now an infraction for which you cannot be put in jail), and even vandalism.

John, a 19 year old, was charged with the unlawful s*x with his girlfriend, Melissa, who was 16 years old. Melissa was a willing participant in s*xual conduct with John, but Melissa’s parents filed a complaint with the police. Melissa had run away from home prior to the trial, but the D.A. still insisted in prosecuting the case. At trial I (David Foos) was able to convince the jury that they should engage in “jury nullification” – that is find the defendant not guilty because the act did not merit a criminal conviction for John. The jury agreed with me and found that John was not guilty.

Being falsely accused of a s*x crime against a minor can leave you feeling indignant, hurt, and even angry.

The natural reaction is to want to defend yourself. But the truth is, any communication of this sort could actually hurt your case.

So what should you do?

1. Avoid making any statements
Don’t speak to anyone about the charges that are levied against you – even relatives or close friends. Certainly don’t speak to the police about your charges. Even if someone claims to support you, don’t give a statement. Instead, let your attorney do the talking for you and direct anyone with questions to your attorney.

2. Consult a s*x crime attorney
One of the biggest mistakes you can make is waiting to hire an attorney. Hiring a lawyer on time will help you to build a solid defense. An attorney will also be able to explain all the possible legal options at your disposal and prepare you for the issues you may be facing.

3. Investigate the strategies used by the police and prosecutors

The crime of unlawful s*x with a minor, or as it is more commonly known, "statutory r**e" occurs when an adult engages in s*xual in*******se with a minor. Under the law, an adult is anyone age 18 or over, while a minor is anyone under the age of 18.

Statutory r**e is prohibited by California Penal Code section 261.5, and the statute is written so as to be gender neutral. This means that both male and female adults can be convicted of the crime, and there is no variation in the application of the statute as between men and women. The statute also does not distinguish between consensual and non-consensual s*x.

While Penal Code section 261.5 is written without any requirement of a mental state, such as "knowingly" or "willfully," the law is not what is commonly known as a strict liability crime. For a strict liability crime, the defendant's intent is irrelevant. A charge of statutory r**e can potentially be defended or mitigated by a claim that the defendant did not know that the person with whom they had s*xual in*******se was a minor.

The penalties that can apply to a statutory r**e charge depend largely on the relative ages of both the defendant and the victim. In some cases the defendant may only be guilty of a misdemeanor, while in other cases the defendant will be guilty of a felony.

Pedro was driving late at night and made a turn onto a freeway on-ramp. He lost sight of the roadway and ran up onto the median and struck a sign, knocking it over. Pedro extricated his car, but did not know who to call about the damage. Pedro’s intent was to call the authorities the next day. A passing motorist saw Pedro’s vehicle intertwined with the sign and called the police. Peter was driving away as the police arrived, and the police pulled Pedro over. He explained that he had not known what to do, but the police cited him for hit and run anyways.

Pedro came to see me (David Foos), and I was able to convince the District Attorney that he acted in good faith and just did not know what to do. Pedro paid restitution for the broken sign and we were able to get the charge dismissed for him.

Bill was distraught from breaking off his relationship with Tina. Bill missed Tina so much that he decided to break into her residence, only so he could be around Tina’s possessions and to remember her. Bill did not intend on stealing anything or committing any felony while within Tina’s house. Although Bill was charged with 1st degree burglary, we were able to persuade the prosecutor that there was no intended theft, so the offense was merely a misdemeanor trespassing.  Bill was sentenced to misdemeanor probation and a fine.
