It PAYS to work with an experienced attorney! Sometimes clients don't know what they don't know! We recently settled a bike vs. auto case where the client thought their own auto insurance wouldn't cover them and didn't give it to us. Mr. Asch was able to get the policy limit of 15k from the defendant but with persistance obtained the auto insurance policy from the client who had uninsured coverage on her auto with100/300 limits! Now they will get much more in their pocket for their pain and suffering!

Uninsured Motorist Coverage...make sure you ask for it and pay for it.

We often get calls from clients who were hit by someone who didn't have insurance. Our clients are hurt, have medical bills and time lost from work as well as pain and suffering. They may have health insurance but have high deductibles. But they will not get any bills paid or reimbursements because the defendant was driving a car without insurance, against California State Law.

Our clients are angry when they can't get the wrongs created by someone else paid for. If they had only asked for Uninsured Motorist coverage, they would be able to use their own policy just as if they were using the defendants!

Many times when I explain this they will say "I told the insurance agent I wanted full coverage when I bought the policy".

You can be the most responsible driver in the world and have your very own auto insurance coverage plan but there are an untold number of drivers out there on the city streets and freeways who drive without any insurance and have no concern for what might happen after an accident. What happens if you get hit by a car owner without any car insurance?

This is where uninsured motorist coverage comes into play. It is estimated that in some states up to 25% of drivers don’t have any form of auto insurance, which is a staggering figure when you think about it. That’s 1 in every 4 cars around you as you trudge along during your morning commute. States have differing requirements, so if you are going on a cross country trip, check out the states you want to avoid! Like Oklahoma and Tennessee!

Auto insurance has many parts but not all coverages are applicable to all drivers. When a driver says they have "full coverage" insurance, it may not mean they have all the coverage they need. Most individuals who refer to full coverage are typically referring to the comprehensive and collision portion of an auto insurance policy in addition to required liability and/or personal injury protection coverage. So call your agent and make sure you have Uninsured motorist (UM) coverage!

and then ask for Underinsured coverage! LOL!

Underinsured motorist (UIM) coverage kicks in when the at-fault driver has liability insurance, but not enough to cover all the costs. In some states, UM also pays when you're the victim of a hit-and-run driver. More on that next time!

This is good news. California should be passing the same ruling soon. Currently the cap is 250k which is only benefitting the insurance companies!

Florida Supremes rule med mal cap unconstitutional



The Florida Supreme Court has ruled the state's cap on noneconomic damages for victims of medical malpractice is unconstitutional in wrongful death cases, in violation of the equal protection guarantee in the state's constitution. The court wrote the cap "serves no purpose other than to arbitrarily punish the most grievously injured or their surviving family members."
