State Bar Board Approves Statement on Recent Federal Executive Actions Threatening the Availability of Legal Counsel and the Rule of Law

As many of you are aware, in recent weeks, the federal government has issued executive orders targeting law firms based on their representation of clients and positions unpopular with the current administration. At its recent May 9, 2025, meeting, the Board of Trustees approved the release of a statement on such actions, which threaten the availability of legal counsel and the rule of law. The Board also authorized amicus participation in lawsuits challenging the executive orders.

To State Bar licensees and the public we serve:

The State Bar of California exists to protect the public through the licensing, regulation and discipline of attorneys; the advancement of the ethical and competent practice of law; and supporting efforts for greater access to, and inclusion in, the legal system. In carrying out its duties, the State Bar of California acts in accordance with certain fundamental principles that define the legal profession and are central to the State Bar’s mission:

Attorneys have an ethical duty to provide competent and diligent representation to clients, regardless of how unpopular or controversial their causes may be. Attorneys must exercise independent professional judgment, free from external pressures or influences that might compromise their representation. Attorneys must not reject, based on personal considerations, the cause of the defenseless or oppressed. All attorneys swear an oath to uphold the United States and California Constitutions, and to faithfully discharge the duties of an attorney to the best of their knowledge and ability. In both the federal and state legal systems, courts determine the meaning of the law, and all attorneys, including those in other branches of the government, have an obligation to comply with court orders.

These core principles, embodied in our Rules of Professional Conduct and the State Bar Act, are not merely aspirational—they are essential to the rule of law and the administration of justice.

When any action, regardless of its source, discourages or penalizes attorneys for representing certain clients or causes, it raises serious concerns about the ability of the legal profession to fulfill its obligations. The independence of the legal profession is a cornerstone of our justice system.

Recent actions of the current federal administration’s executive branch (the Administration) threaten these core principles. The Administration has taken actions against law firms, including through executive orders against certain law firms and negotiations that have resulted in agreements with others, based on those law firms’ representation of clients and positions unpopular with the Administration. Many of the representations criticized by the Administration are matters undertaken on a pro bono basis for indigent individuals, such as providing immigration legal services.

The Administration’s actions have included directions to government agencies to revoke law firm employees’ security clearances, limit access to federal buildings and employees, refrain from hiring law firm employees, and require federal contractors to disclose any business with targeted law firms.

Such actions directly imperil the ability of lawyers at these firms to competently represent their clients and have a chilling effect on the availability of competent legal counsel to represent clients unpopular with the Administration. This effect may be particularly harmful for those who lack economic means and rely on pro bono representation to access legal services. The threat to the legal system of these actions targeting law firms is such that United States District Court Judge Beryl Howell on May 2, 2025, permanently enjoined enforcement of an executive order issued against a law firm “to protect the independence of counsel to represent their clients vigorously and zealously, without fear of retribution from the government simply for doing the job of a lawyer.”

The State Bar reaffirms that all lawyers must be permitted to exercise their professional judgment and ethical duties without fear of reprisal. This position is not partisan but foundational to the advancement of ethical and competent practice of law and the preservation of the rule of law.

The State Bar encourages California attorneys, consistent with their oath to uphold the United States and California Constitutions, and to faithfully discharge their duties as attorneys, to speak out in support of the right to and availability of competent legal counsel to all and of the rule of law.

I don't often feel nostalgic .... but this sort of does it. I was just a child when the Andy Williams Show was on the air, but it brings back memories of my family all gathered in the living room to watch incredible artists share their craft. A free concert every week... Pearl Bailey; Peter, Paul & Mary; Sammy Davis, Jr.; Judy Garland; The Osmonds, Ray Charles ..... Makes me a little sad that there are no more shows like that.

When you have a neurotypical child, you feel reasonably assured that class participation and decent study habits will result in good grades. These kids have close friends. They get invited to participate in social things like dances and weekend gatherings. They make the teams, auditions, organizations and clubs.

But when you have a child with certain differences, this is often not the case. Learning may take longer, both academically and socially. Despite their tremendous efforts, results are often a fraction of their peers and social acceptance is fleeting, setting them up for painful comparisons and bitter frustration. Instead of a fun and fulfilling experience, school can become a breeding ground for depression and anxiety, and assignments a battle ground at home. It is exhausting for parent and child alike.

This is the week of SPED (Special Education), Autism, Dyslexia, and ADHD (Attention Deficit Hyperactivity Disorder) awareness.

For all the children who struggle every day to succeed in a world that does not recognize their gifts and talents, and for those who are walking beside them, please let this be a gentle reminder to be kind and accepting of ALL people. Recognize that the "playing field" is not always a level surface.

Children who learn differently are not weird. They are merely gifted in ways that our society does not value enough. Yet they want what everyone else wants: To be accepted!!

If you choose, please "copy and paste" (by touching and holding the text) onto your profile in honor of all children who are deemed "different". Our world would be far less beautiful without them.

Last year, my mother-in-law passed away. This year my own mother also passed away. While it would seem that we have certainly been through the wringer these last (almost) two years, I can only be grateful. My mother, Penny to all who knew her, was 92 years old and while she was diagnosed with Alzheimer's a little over a year before her passing, I am so incredibly thankful that I, my husband and my siblings were united in caring for her. Mom was able to stay in her own home because we (lovingly and proudly) provided 24/7 care for her. She took her last breath while my sister and I held her in our arms. I am so humbled and grateful to have been able to love and care for my mother as she needed - as she deserved. I am so thankful that God enabled me to be there for my mom and that He allowed me to have the perspective that I was right where I needed to be. Now ... I look forward to heaven all the more knowing my loved ones will be there to greet me when my time comes. There is nothing in this world so important, humbling, freeing, uplifting, reassuring, empowering as love.

My mother-in-law, Shirley, passed away two days ago. For 30 years, I have had the honor of being her grafted-in family. She loved (loves) me and I love her. With my husband, I had the joy of caring for her in her last days. I am so grateful to have no regrets, to have been able to demonstrate my love and respect for her in such a personal way. If you have the opportunity ... I highly recommend taking the opportunity to ensure your valued elderly leave this place well-loved. It is worth any sacrifice you must make.

Someone asked me a few days ago what I value about being an attorney. It is a difficult profession - not much gratitude and plenty of criticism. Sometimes, I don't find much value.

BUT I always go back to the truths that have kept me in this business for 30 years....
1. It is a noble profession. Think Abraham Lincoln, Thurgood Marshall, Barbara Jordan, Margaret Brent 1st woman lawyer in the U.S. -before it WAS the U.S. -before women could vote or own property.

More than half of America's presidents have been lawyers.

2. Lawyers have helped shape our unique country - 35 of the 55 delegates who attended the Constitutional Convention of 1787 were lawyers or had legal training. Lawyers have pursued and obtained rights for the oppressed and needy throughout history.

3. Lawyers speak for those who can't, defend our government and, while zealously representing their client, must never forget that first and foremost is the great responsibility to do it with integrity and in pursuit of justice.

It is easy to forget why we "practice" law. The beauty of the profession can be strangled and mangled in the battle field of litigation and life.

So what do we do? Give up? Become jaded? Turn from a profession to a job? Sling burgers?

I suppose we each must come to our own conclusion - and maybe that conclusion changes as we change.

MY desire is to remember:
Remember the ones who came before me and made my career possible; remember the times my profession has saved a life, changed a country, restored a treasure; remember my family's sacrifices to get me through law school - debt free; remember my dad's face - full of love and pride- when we read the letter that said I passed the bar exam; remember that Jesus turned to the law for answers as well:

A Court Holiday By Any Other Name...

QUESTION: How far do we take the Court Orders being issued that declare emergency court closures to be "court holidays"?

Through its Order, the Court has declared the period of March 20, 2020 to March 30, 2020, inclusive, to be court holidays for all purposes

"The time in which any act provided by law is to be done is computed by excluding the first day and including the last, unless the last day is a holiday, and then it is also excluded." Cal.Civ. Code §10; see also Cal.Civ.Pro. Code §§12, §12a,(a) and Cal.Gov't Code, § 6800.

"Holiday" includes Saturday [CCP §12a(a)]; Sunday [GC §6700]; the other standard holidays prescribed by law [i.e., New Years', Cesar Chavez Day, etc GC §6700 as modified by CCP §135]

Finally: "If any city, county, state, or public office, other than a branch office, is closed for the whole of any day, insofar as the business of that office is concerned, that day shall be considered as a holiday for the purposes of computing time under Sections 12 and 12a." Cal.Civ.Pro. Code §12b.

There is one case that addresses a similar situation: Bennett v. Suncloud, (1997) 56 Cal.App.4th 91, 94 (superseded by statute on other grounds per Leitner v. Sadhana Temple of New York, Inc (2014) 2014 WL 12588645). In Bennett the reviewing Court determined that there was a triable issue of fact as to whether a court closure after the Northridge earthquake fell within CCP §12b. Specifically, the issue was whether only the “branch” location was closed or the main downtown courthouse was also closed.

Based upon the Courts’ Emergency Orders, it looks like we are able to assume that anything required to be filed with the Court is extended until the Court is once again open because the orders do not cover only the branch locations, but all of the locations. For example, a call to the Sacramento County Main Courthouse, nets you a voicemail that says the Courthouse is closed and there is a drop box at the main location for emergency filings. The call is referred to the website and the call ends.

But what about other deadlines? Those that don’t require a visit to a courthouse or the intervention of a judge? For example, meeting and conferring prior to filing a demurrer? Serving discovery responses via mail?

These kinds of deadlines are also usually extended during holidays as well. But then, during the usual holidays, the post often does not usually run and most law offices are closed. This is not necessarily the case with regard to the present court closures. On the other hand, for some holidays offices are open - not to mention the fact that email never shuts down (well ... absent technology issues).

If this becomes an issue in an individual matter will the judge approach his or her analysis from the strictly statutory approach - a court holiday is a court holiday and it has the effect as provided for in statute. Or will the courts make a distinction between the declaration of a holiday for court filing purposes and those that could proceed despite closures?
It remains to be seen what kind of motion practice this will generate among parties who may have differing points of view.

As with just about everything concerning Covid-19 – the situation is novel, fluid and unpredictable.

Some Practical Suggestions

A. DOCUMENT absolutely everything you can. Phone calls; emails; letters

B. consider (and document) the following 1. is your firm open for business? 2. is opposing counsel's firm open for business? 3. is there a written agreement for electronic service?

C. have a conversation with all parties and consider one another's position on the calendaring issue

D. when in doubt - meet every deadline you can.
