Recent preliminary hearing victory....they rarely come.
Client charged with 5 counts
1. R**e by force
2. Kidnap for purpose of r**e
3. Robbery
4 . Attempted Kidnap
5. Kidnap with Intent to commit R**e

Facing over 30 years to life in prison....

At preliminary hearing, which is a hearing to determine probable cause (usually a rubber stanp by most judges) the DA called one of the actual (alleged victims) to testify.
During questioning on the stand, alleged victim finally admits that she lied about being r**ed, they never even had s*x Admitted that she was a pr******te and she was trying to make him pay.

Count 1 and 5 dismissed, with the judge adding count 4, saying ...."I'm barley holiday him to answer" and cout 5 dismissed.

Went from 2.5 million bail, to no bail and now 250k for bail. Client was looking at the rest of his life in prison, now at trial, will be facing much less and probably a full not guilty verdict. Client has been in custody for over 5 months due to these lies.

Can not wait to try this case in front of a jury.....dont believe everything that is reported!!! Sometimes people lie and those lies have life long results.

Great result today!!
Was set for trial on a 4year old felony dui with great bodily injury. Case was already dismissed once at preliminary hearing, DA re-filed and tried again; set to start trial next week. Client was facing upto six years in prison with a strike...turned down a misdemeanor offer.

Today at Trial Readiness Confrence, we announced ready for trial next week....DA dismissed entire case!!!

Congratulations to a strong client who had faith in our trial skills and was not accepting anything but a full dismissal!!

In April 2024 was when the trial was set for the case but was postponed because of a lack of a trial court at that time, the district attorney’s office

Verdict Alert!

Just finished a jury trial in Colusa County....first and last one there. Client originally charged with 5 counts:
1. Pc 245(a)(1), assault with firearm(felony)
2. Pc 417.3, felony exhibition of a firearm at a vehicle (felony)
3. 25400, possesion of a firearm (misdemeanor)
4. 11350 Possesion of drugs (misdemeanor)
5. 11377 Possesion of drugs (misdemeanor)

Prior to trial DA dismissed pc 245. During trial DA dismissed pc 25400. At trial jury found client NOT GUILTY of only felony count remaining, and found guilty on misdemeanor drug possesion. We conceded that the only thing our client was guilty of was simple drug possesion....jury agreed.

Congratulations to a client who stood strong and was not bullied by the government bullying tactics and over charging. Another win!!
