Recent preliminary hearing victory....they rarely come.
Client charged with 5 counts
1. R**e by force
2. Kidnap for purpose of r**e
3. Robbery
4 . Attempted Kidnap
5. Kidnap with Intent to commit R**e
Facing over 30 years to life in prison....
At preliminary hearing, which is a hearing to determine probable cause (usually a rubber stanp by most judges) the DA called one of the actual (alleged victims) to testify.
During questioning on the stand, alleged victim finally admits that she lied about being r**ed, they never even had s*x Admitted that she was a pr******te and she was trying to make him pay.
Count 1 and 5 dismissed, with the judge adding count 4, saying ...."I'm barley holiday him to answer" and cout 5 dismissed.
Went from 2.5 million bail, to no bail and now 250k for bail. Client was looking at the rest of his life in prison, now at trial, will be facing much less and probably a full not guilty verdict. Client has been in custody for over 5 months due to these lies.
Can not wait to try this case in front of a jury.....dont believe everything that is reported!!! Sometimes people lie and those lies have life long results.
