Securing accountability in catastrophic injury: A $33M verdict against the City of Sacramento

Dreyer Babich Buccola Wood Campora, LLP secured a $33 million jury verdict on behalf of our client, Michael Flynn, a UC Davis theoretical physics doctoral student who suffered a severe traumatic brain injury when a decayed tree limb collapsed on a McKinley Park running path.

The jury found the City of Sacramento 100% liable for failing to maintain safe public spaces and relying on park visitors rather than qualified inspectors to detect dead limbs, leading to the largest single-plaintiff award in a general negligence case in Sacramento County and the largest single-plaintiff verdict against the City of Sacramento.

While Michael has shown extraordinary resilience, severe TBIs permanently reshape careers, families, and everyday lives.

$33.3 million verdict for Michael Flynn after McKinley Park tree accident.

A routine jog through McKinley Park changed Michael Flynn’s life forever.

In April 2020, Michael Flynn was pursuing his doctorate in theoretical physics when a massive dead tree limb fell on him in Sacramento’s McKinley Park, causing a devastating brain injury.

An MIT graduate pursuing his Ph.D. at UC Davis, Michael went on to earn his doctorate despite multiple brain surgeries. His permanent injuries have profoundly changed his life and his ability to pursue the scientific work he envisioned.

A Sacramento jury found the City 100% responsible. Following jury and court proceedings, Michael was awarded $33.3 million—a record single-plaintiff verdict against the City of Sacramento.

“The most troubling part of this case is how easily this could have been prevented,” said attorney Robert Buccola.

A Placer County jury has unanimously awarded $15.8 million to Miranda Flores. Her husband, retired CHP officer Patrick Seamus Mulderrig, was killed in a 2024 Granite Bay crash when developer Phil Oates turned left in front of his motorcycle on Douglas Boulevard.

Oates was never charged with a crime or cited. But all 12 jurors agreed he must be held accountable.

"This has always been a case about accountability and responsibility," said attorney Roger Dreyer.

"I am so thankful to this jury for understanding and recognizing how remarkable my husband Patrick was and the depth of my loss," Miranda said.

Our thoughts remain with Miranda and the Mulderrig family.
