MH Partner David E. Mastagni provided powerful testimony on June 9, 2026, before the California Assembly Judiciary Committee on SB 747 (the “No Kings Act”), representing the Peace Officers Research Association of California (PORAC) and local law enforcement agencies across the state.

David focused sharply on the critical need to preserve qualified immunity — the vital legal protection that enables peace officers to perform their duties without fear of personal liability for good-faith decisions made in rapidly evolving, high-stakes situations. He emphasized that while the bill attempts to allow officers to assert qualified immunity, its language falls short of clearly adopting the established federal standard under 42 U.S.C. § 1983.

This ambiguity could create a weaker, uncertain state-level standard, exposing California’s officers to increased litigation risk and undermining the consistency and predictability essential to effective policing.

David urged the Committee to adopt amendments that explicitly safeguard the full scope of qualified immunity protections officers currently rely upon.The bill advanced out of committee, but David continues to lead the fight to strengthen these protections and shield public safety professionals from overreach.
