What you say about your ex during a divorce could come back to haunt you in court.

Negative comments made in front of your children, friends, or family members can damage relationships, escalate conflict, and potentially affect your divorce or custody case.

Even when emotions are running high, choosing your words carefully can help protect your interests. Sometimes, saying nothing is the smartest decision.

Considering divorce in Sacramento? Speak with an experienced family law attorney before making decisions that could affect your future.

Actually, mediation is designed for couples who don't agree.

In divorce mediation, a neutral mediator helps you and your spouse work through the issues you disagree on, like property, support, and parenting schedules. The mediator doesn't take sides or make decisions for you. Instead, they help you communicate, explore options, and find solutions you can both accept.

Mediation can:
๐Ÿค Keep decisions in your hands, not a judge's
๐Ÿค Reduce conflict, which matters especially when children are involved
๐Ÿค Often save time and money compared to litigation

Mediation works best when both spouses are willing to participate in good faith. It may not be the right fit in every situation, such as when there's a history of abuse.

Whose name is on the title doesnโ€™t always tell the whole story when property is divided in a California divorce.

Property rights can depend on when and how an asset was acquired, how it was paid for, and other factorsโ€”not simply whose name appears on the paperwork.

Have questions about your property rights in a divorce? Contact Bartholomew & Wasznicky LLP to schedule a consultation and discuss your specific situation.

Children shouldnโ€™t have to carry the weight of their parentsโ€™ divorce. Keeping difficult discussions between adults can help protect them from unnecessary stress and allow them to focus on simply being kids.

Your 401(k) may be one of the biggest assets in your divorce, and many people are surprised by how it's divided.

In California:
๐Ÿ’ผ Contributions and growth during the marriage are generally community property, shared equally
๐Ÿ’ผ What you saved before marriage is usually yours
๐Ÿ’ผ What you contribute after your date of separation is usually yours, too

Dividing a retirement account often requires a special court order called a QDRO. Some couples instead trade other assets so each spouse keeps their own account intact.

After weeks or months of working through the issues as a team, the final step in collaborative divorce is putting everything you've agreed on into writing.

Here's what typically happens:
๐Ÿ“ Your collaborative attorneys prepare a marital settlement agreement that reflects the decisions you made together
๐Ÿ“ Final financial disclosures are completed, unless both spouses agree to waive them
๐Ÿ“ The signed agreement and court forms are submitted to the court

A judge reviews and signs the judgment, but the terms are the ones you and your spouse created, not decisions imposed by the court. And because you built the agreement together, it often fits your family better and holds up better over time.

Finding love again after divorce can be a wonderful thing. When children are involved, though, how and when you bring a new partner into their lives makes a big difference.

A few things that help:
๐Ÿ’› Wait until the relationship is stable before making introductions
๐Ÿ’› Start with short, low-pressure time together
๐Ÿ’› Reassure your kids that no one is replacing their other parent
๐Ÿ’› Consider giving your coparent a heads-up before a big introduction
๐Ÿ’› Save bigger steps, like sleepovers or moving in, for later

Children need time to adjust to change. Going slowly gives them space to process it, and it helps keep things calmer with your coparent too.
