As Klinedinst PC continues to grow, we're excited to welcome John Paul Chakbazof as an Associate in our Sacramento office. John's practice focuses on general liability and personal injury defense, where he'll help clients navigate complex litigation with strategic advocacy and practical solutions.

John brings extensive courtroom experience from his time with the Riverside County Public Defender's Office, where he managed preliminary hearings, motion practice, client counseling, plea negotiations, and courtroom litigation. Think your cookie banner is protecting your business from C**A liability? It might not be.

Recent cases are making one thing clear: having a “Reject All” or “Deny Non-Essential” button isn’t enough if tracking continues after a user opts out.

As part of our ongoing C**A risk awareness series, here are a few real, recent examples showing how businesses may still face exposure when tracking technologies continue running after users decline consent:

• A major amusement park chain allegedly continued tracking after users clicked “Deny Non-Essential.” The court allowed the C**A claim to move forward.

• A global cellular provider allegedly kept third-party scripts firing even after users selected “Reject All.” The court refused to dismiss.

• A national fitness retailer’s session replay software allegedly captured keystrokes, billing details, and IP addresses, with disclosure buried in 7.5-point font. That claim is also moving forward.

What courts are focusing on is simple:

Klinedinst PC joined fellow attorneys and legal leaders this month at the GOOD Guys program, hosted by the San Diego County Bar Association (SDCBA) and Lawyers Club of San Diego, for discussions centered around allyship, leadership, and inclusion in the legal profession.
