AB 1824 is advancing through the California Legislature and is headed to the Senate Judiciary Committee this month. California Indian Legal Services, California Tribal Families Coalition, Morongo Band of Mission Indians, and Habematolel Pomo of Upper Lake co-sponsor this bill.

❔What AB 1824 does: AB 1824 strengthens protections for Indian children in probate guardianship and conservatorship proceedings by codifying ICWA requirements directly into the California Probate Code. The bill establishes clear duties to inquire whether a child is an Indian child, requires active efforts to prevent family separation, mandates Tribal notification and the right to intervene, ensures culturally appropriate placement preferences, and affirms Tribal sovereignty throughout the process.
