Q: Did you know that selling a home during probate in California requires court approval or confirmation?

A: It’s true! In California, if you’re selling a home that’s part of an estate going through probate, the process isn’t as simple as a standard real estate transaction. The sale can require approval from the probate court to ensure it’s in the best interest of the estate and its beneficiaries. Additionally, the sale price must be within 90% of the appraised value. However, if the executor has full independent authority under the Independent Administration of Estates Act (IAEA), some of these steps may be streamlined by using a Notice of Proposed Action.
