Kansas Supreme Court upholds our firm's previous victory declaring breath test results inadmissible in DUI cases. On Friday June 30 the Kansas Supreme Court reaffirmed it's previous decisions in State v Nece and State v Ryce declaring the Kansas refusal law unconstitutional and test results obtained inadmissible in DUI prosections.

BIG WIN FOR HOLLAND AND HOLLAND!!! DUI Refusal statute declared unconstitutional making breath or blood tests obtained inadmissible.

A series of related cases was decided by the Kansas Supreme Court on February 26, 2016, addressing various aspects of the Kansas DUI law. The Court in State v. Ryce, found the DUI Refusal law to be unconstitutional.

The Court went on to find in State v. Nece, that breath or blood tests obtained after unlawfully advising suspects that a refusal of testing constitutes a crime are inadmissible as being illegal searches.
