⚠️ New Form I-864 Edition Now Required

USCIS is now requiring the new 08/24/26 edition of Form I-864, Affidavit of Support, for filings submitted on or after August 31, 2026. There is no grace period, and outdated editions will be rejected.

🔍 The updated form also includes expanded authorization for USCIS to verify a sponsor’s financial information, including through consumer reporting agencies. Sponsors with credit freezes or locks should review their credit settings before filing.

📋 USCIS is also introducing new editions of Forms I-539, I-765, and I-485 in September.

A federal court has overturned the suspension of immigrant visa processing for applicants from 75 countries.

This is significant news for family-based and employment-based immigrant visa applicants. However, the timing matters. With FY2026 ending on September 30 and the new fiscal year beginning October 1, the return of visa demand from these countries could create major changes in the Visa Bulletin.

USCIS Moves Toward Mandatory Electronic Filing

DHS has issued a new interim final rule giving USCIS authority to require electronic filing for certain immigration forms.

Under the new rule:
• USCIS may require e-filing for forms that have been available online for at least 180 days.
• USCIS must provide at least 60 days’ notice before making e-filing mandatory for a specific form.
• Applicants who cannot file electronically may request a waiver based on undue hardship, but approval is discretionary.
• The rule takes effect August 11, 2026.

As USCIS expands electronic filing, applicants should check the current filing requirements before submitting an immigration application or petition. Filing incorrectly could result in delays or rejection.

Public Charge Bonds for Certain Immigrant Visa Applicants

The Department of State is currently using a pilot program that allows consular officers to require certain immigrant visa applicants to post a Public Charge Bond.

If required, the applicant will be notified by a consular officer. The bond amount is determined based on the individual circumstances of the case and may provide a way to overcome a public charge denial under INA § 212(a)(4), if the applicant is otherwise eligible for the immigrant visa.

This process is currently being used only for select applications. Applicants should carefully review any instructions from the consulate and understand the financial obligations and potential risks before proceeding.

Trump Signs New Orders Targeting Birthright Citizenship

President Trump signed two new executive orders on August 6, 2026, targeting birthright citizenship and so-called “birth tourism.”

The orders seek to:
• Restrict citizenship for certain children born in the U.S., including specific cases involving foreign government employees and alleged fraud.
• Direct the Department of State and Department of Homeland Security to take stronger action against suspected birth tourism, including potential visa consequences.

The orders come just weeks after the U.S. Supreme Court reaffirmed that children born in the United States to parents who are unlawfully or temporarily present are generally entitled to U.S. citizenship under the Fourteenth Amendment.
