Being a judgment creditor in GA is a powerful thing. You have many tools to get a debtor to pay a judgment. Post judgment discovery is something that a lot of attorneys don't use properly. A judgment debtor is required to respond to post judgment discovery and when they don't (which is OFTEN the case), the law allows you to seek an order compelling responses. When the debtor fails to comply with the court order, then you can seek an Order holding the debtor in contempt and requesting the Court to incarcerate the debtor for violating a court order.

This week, I handled a case in Columbia County GA. Judge Jolly is no-nonsense. Judge Jolly held the debtor in contempt, granted my client additional attorney's fees and gave the Doctor CEO 30 days to pay the judgment or face incarceration for her absolute failure to respond to my post judgment discovery.

It has been a while since I posted about my law practice, but we have obtained great results for our business clients! My firm is not only handling Xerox Corporation's GA litigation, but we just picked up Florida!

Also, I have spent 22 years defending companies alleged to have violated fair debt collection laws. Unfortunately, these federal laws draw bottom feeder attorneys to sue debt collectors and attorneys because these laws allow attorney to shift their fees from the client to the debt collector or attorney defendant. I recently won a case that is under appeal....that I will refer to as the F*** You case. My client was sued under the Fair Debt Collections Practices Act for telling another attorney to go F*** himself. Opposing counsel alleged that my client words were directed at the consumer and therefore the attorney was an extension of the consumer. I argued that the FU was not related to debt collection, but rather the conduct of the consumer's attorney. The district court agreed with me and now the opposing counsel has appealed. I believe this is a wrongful appeal and I will seek additional attorney's fees for the wrongful appeal.

My client is a Roofing Company. Acting Pro Se, my client sued a customer for an unpaid debt in Magistrate Court. The customer filed counterclaims and lost at the Magistrate Court level. The customer then doubled down and decided to appeal the Magistrate Court judgment to State Court. Since business entities have to be represented by an attorney in State and Superior Court, I got involved. I amended the complaint, served the Defendant with discovery and filed a Motion for Summary Judgment. The Court ruled in my client's favor and entered judgment against the Defendant/Customer in the following amounts. Please note the additional damages for filing a frivolous appeal.
Principal: $4,350.00;
Interest: $345.45;
Attorneys’ fees: $5,662.78;
Costs: $172.78;
Frivolous Appeal damages: $1,087.50
TOTAL: $11,618.51

Great news for Xerox. I filed a lawsuit against a company named, Unified Consultants and obtained a judgment. I served the CEO with post-judgment discovery and they failed to respond. Along with my paralegal, Lana Duffoo, we obtained an order of incarceration against the CEO. He just settled the lawsuit and judgment. Happy client = Happy attorney!

Great results for my client. She loaned her former step-daughter $80,000.00, interest free for her business. The loan was slowly repaid over 13 years with an outstanding balance of about $40,000.00. When my client divorced the debtor's dad, the debtor thought it was just cause to no longer pay. I filed suit and recovered the entire balance due. I like to treat clients like I would like to be treated, so I gave my client a discounted rate for recovering the debt prior to filing any motions. Karma!
