One of the most rewarding aspects of my job as an Estate Planning attorney is the satisfaction of helping families protect what matters most to them.

Having a current, well-written Will can go a long way toward avoiding problems, if something were to happen to you. If it’s been a while since you wrote your Will, now is a good time to take it out and read over it. Has it gathered a lot of dust since you signed it?

This article is right on the money - adding your children to the title of your home is generally not a good idea, for multiple reasons. Problems can include increased capital gains taxes being paid by your children, and the potential for claims against the property from creditors of your children. Consider a Living Trust instead.

REAL ESTATE MATTERS | In a nutshell, it might be better for your mom to put the home in a living trust that allows her to control the home while she is alive and allow you to inherit the home through the trust upon her death.

It was an honor to speak last night on Wills, Trusts and Estate Planning at the Pathway to Retirement Seminar, benefiting the Emory University Children's Cystic Fibrosis Center of Excellence. The seminar continues on September 17th and 24th, supporting important medical research and treatment for cystic fibrosis.

Gloria Vanderbilt’s estate was much smaller than expected, apparently due to bad business decisions, malfeasance by some of her advisors, and a high-cost lifestyle. While we don’t know precisely how much she lost, many of the losses likely could have been avoided if the assets she inherited from her parents had been placed in trust for Gloria, managed by a corporate fiduciary.

Fortunes faded.
