Check your Beneficiary Designations

A recent California Court of Appeals Case Estate of Post (A151975, Filed June 22, 2018, California Court of Appeal, First District, Div. 1) held that a life insurance policy must be paid to the decedent’s ex-wife, instead of to his children from a prior marriage, because she was still named as primary beneficiary on the policy’s Beneficiary Designation form. This was the result even though the Decedent had a will that specifically stated he did not want her to receive any of his assets, including any assets received because of a beneficiary designation. This is because Court cannot control assets that do not involve the estate and assets with beneficiary designations generally pass outside of an estate.

Lesson: Regularly check your beneficiary designation forms. Those forms will control where your policies will end up despite what you may say elsewhere.
