This delay resulted in the child having one of his legs amputated as well as a toe on the other foot. The hospital, nurses and doctors paid $12.5 to settle this medical malpractice lawsuit.

-$12 million medical malpractice jury verdict against an oral surgeon involving wrongful death.

-$11.24 Million settlement. Our client suffered quadriplegia in an accident involving the product. The case settled for the sum of $11.24 million. The specific facts of the case and the terms of the settlement are confidential

-$11 Million Jury Verdict for defective medical device. This was the first pelvic mesh jury verdict against Johnson & Johnson in the country.

-$10 Million Jury Verdict for failure to provide police protection. This Action was brought on behalf of a young child who was severely burned by a Molotov Cocktail explosive device that was thrown into the bedroom of his family’s apartment by an unapprehended perpetrator. The jury awarded $10,000,000. in compensatory and punitive damages, which award was reduced by the trial judge to $2,400,000. and affirmed on appeal. The jury found that the police broke their promise to the victim’s family to put surveillance on their home on the night of the attack in order to catch the perpetrator in light of prior similar incidents and pending threats against a family member. (Results may vary depending on your particular facts and legal circumstances)

If your child was hit by a car, the days that follow can feel overwhelming. But taking the right steps early can protect your child's health and your ability to pursue a claim.

Medical care comes first. Even if your child seems okay, some injuries, including internal injuries and traumatic brain injuries, are not immediately obvious. A full medical evaluation allows medical providers to properly evaluate your child and document the injuries and symptoms.

In addition, there are steps to take to protect your child’s ability to be compensated for their injuries:

✔️ Preserve evidence: Take photos of the scene, your child's bike, and any visible injuries as soon as you can. Physical evidence can disappear quickly.

✔️ Get the police report: If law enforcement responded, request a copy. It documents the driver's information, witness accounts, and the officer's initial findings.

✔️ Don't speak with the driver's insurance company: Insurers may reach out early. Anything you say can be used to reduce or deny your child's claim.

✔️Determining how your child’s medical bills will be paid. Depending on the scenario, the medical bills may be paid by your health insurance, your automobile insurance or there may be no insurance available at all. An experienced attorney can help you determine how the medical bills will be paid.

If your personal injury case goes to trial, knowing what happens at each stage helps you walk in prepared. In New Jersey, a trial moves through five stages:

✔️ Jury selection: Both sides question potential jurors and may request that certain potential jurors be excused from serving on the jury. The goal is to seat a jury that can weigh the evidence fairly and set aside any preconceived bias or prejudices.

✔️ Opening statements: Each side explains what they plan to prove, providing a preview of the case each party plans to present.

✔️ Presentation of evidence: Your attorney calls witnesses, including you, your medical providers, and/or hired experts. The defense does the same. Both sides have an opportunity to cross-examine the other's witnesses.

✔️ Closing arguments: Each side summarizes the evidence and makes the case for why the jury should find in their favor.

✔️ Jury deliberation and verdict: The jury reviews the evidence and reaches a decision. In New Jersey, personal injury cases are decided by six jurors, and at least five of the six must agree on a verdict.

Filing a personal injury lawsuit is unfamiliar territory for most clients, who are unfamiliar with the process. After a lawsuit is filed, the first stage of litigation is called “discovery.”

Discovery is when both sides share information. On your behalf, your attorney will provide information to the defense, including medical records, incident or police reports and other versions of the accident. We will also seek information from the defendant including their version of the accident, photographs, videos and in some cases, the defendant’s internal documentation. This is called written discovery.

After written discovery is exchanged between the parties, the next step is the Depositions stage. This is when the parties and non-party witnesses are questioned under oath while a court reporter takes down everything said during the deposition.

After depositions, the parties will exchange reports from experts that the parties have retained. This could include experts discussing liability for the accident and/or the client’s injuries and economic damages.

How long Discovery will last depends on your case.

If you were hurt on a construction site in New Jersey, what you can do depends on how you were employed and what caused your injury.

If you're an employee, workers' compensation covers your medical bills and a portion of your lost wages, no matter who was at fault. But it doesn't cover pain and suffering, and it limits your ability to sue your direct employer.

However, if a third party, such as a property owner, general contractor, subcontractor, or equipment manufacturer caused your injury, you may be able to file a personal injury claim in addition to your workers' compensation claim.

In New Jersey, property owners and general contractors are legally responsible for keeping job sites safe. A few things affect whether a third-party claim is strong:

✔️ Who was running the job site: The party that controlled the work and the property carries responsibility for conditions on site.

✔️ What caused the injury: Falls from scaffolding, equipment failures, and exposure to hazardous materials each involve different legal considerations under New Jersey law.

When an insurance company offers you money shortly after an accident, it can feel like things are moving in the right direction. But the insurance company is not on your side. Early offers, though, often don't fully account for the pain and suffering you have and will endure.

Insurance companies make early offers to try and take advantage of you while you are vulnerable and before you can consult with a legal professional who better understands the value of your case. An early offer from the insurance company might not be enough to cover your future medical costs, the time you've lost from work, or the long-term effects of your injuries. Worst of all, once you accept a settlement, you can't go back for more money, even if your condition gets worse.

Before accepting anything, you should consult an attorney who will look at:

✔️ Where you are in your treatment: Settling before you're done with treatment, or before your doctors know what your recovery will look like, can leave future costs uncovered.
