The final document in our estate planning package is the Last Will and Testament. This is the most complex of the three documents as it addresses everything that happens to your estate, dependents and beneficiaries after you die. The most obvious purpose of this document is to state exactly how you want your estate assets to be distributed. You also will name an executor(s) to handle managing this process. Additionally, a guardian(s) can be named if you have minor children, and a Testamentary Trust can be created to help younger/at-risk beneficiaries manage their share of the estate.

The second document that our office provides is the Advanced Healthcare Directives. This document addresses several healthcare-related issues. First, it gives you the opportunity to name a person/people who can make healthcare decisions for you if you are incapacitated. Second, it contains the Living Will. The Living Will allows you to reject life saving/life extending measures if you are terminally ill or permanently unconscious. Finally, you can elect whether or not you wish to donate any organs/tissue.

This week I will be highlighting the three documents that our office drafts as part of our basic estate planning package.

The first document is the Power of Attorney (POA). The POA allows you to name a person/people to act on your behalf financially, either due to incapacity or simply as a matter of convenience. These rights terminate upon your death, and then the executor of the estate assumes financial responsibility.

In Connecticut the probate process if a married couple dies owning everything jointly is very simple. It is called a Tax-Purposes Only estate ("TPO"), and many people are comfortable enough with the streamlined probate process that they handle it themselves. However, if even one significant asset (i.e. bank account, vehicle, etc) is solely owned by the deceased spouse, the surviving spouse will have a more complex probate process. This is one of the many reasons why estate planning is important- because not even a psychic/medium can make changes postmortem!
