One of the many changes to the landlord/tenant laws of New York:

One of the newest items that will affect landlords and property managers is subsection (d) of Section 235-E, duty to provide a written receipt. Landlords are now required to send a written notice to the tenant by certified mail specifying the rent due. This notice cannot include any rent due that is not at least 5 days late, and should only include base rent amounts. If the certified mail notice is not sent, the Tenant can have the case dismissed.

How is child custody determined?...

The courts use the "best interest of the child" test to determine which parent receives custody of the child(ren). There are a number of factors a court considers in determining which parent best meets the needs/interests of the child(ren), some of these factors are:
• Stability,
• Who has better child care arrangements,
• Who is the primary caretaker,
• Drugs and alcohol use by the parents.

Child custody... what is it?

Most people don't realize that when trying to establish custody of a child, the court is actually trying to determine 2 different types of custody.

The first type is "Legal" custody. This determines who has the right to make important decisions about a child's care, such as medical care, religious upbringing, etc. The court can grant joint legal custody, meaning the parents make major decisions about the child together, and it doesn't matter which parent the child lives with; both parents must agree on the decisions together. If the court gives one parent sole legal custody, only one parent has the right to make major decisions for the child.

The second type is "physical" or residential custody. This determines who is responsible for the actual physical care and supervision of a child. The court can grant "joint physical" custody, where the child resides with each parent an equal amount of time. The court can also direct that the child lives with one parent more than 50% of the time. In this situation the parent who has the child more than 50% of the time is called the "custodial" parent, and the other parent is the "non-custodial" parent who normally receives visitation periods with the child.
