100% bonus depreciation is back!

The 2025 tax law (OBBBA) made it permanent for any property placed in service after January 19, 2025. For Seacoast NH multifamily owners, that's not a small change.

On a $725K Rochester four-unit, a cost segregation study can add about $143K of year-one depreciation, roughly $46K in federal tax savings for a high-bracket buyer. NH has no state income tax, so the full federal benefit stays in your pocket.

If you closed in 2024 or 2025 and skipped cost seg, you can still claim it. Form 3115, no amended return needed.

The proposed cap: 5% (or inflation, whichever is lower), applied even at unit turnover. The 135-unit workforce housing complex delivers studio through three-bedroom apartments with all-utilities-included pricing (electricity, heat, hot water, high-speed internet) on a former brownfield site. A real win for Somersworth and a meaningful new piece of the Seacoast supply picture.

Three things landlords should watch:

The Overlook resets the Somersworth comp set in a useful way. All-utilities-included pricing on a $1,950 1BR is roughly equivalent to $1,650 to $1,700 where the tenant pays utilities. For existing Somersworth product, lead with what a brand-new 135-unit building can't easily match: outdoor space, off-street parking on a quieter block, faster move-in, and the kind of personal landlord touch scaled property managers rarely deliver.

HB 631 takes effect July 1. The multifamily-by-right framework applies to commercially zoned parcels with public water and sewer. If you have a candidate parcel, the next 60 days are the time to confirm utility availability and run a yield-on-cost.

Portsmouth's Congress Street is getting torn up through June. New sewer, water, and stormwater infrastructure designed to handle higher density downtown and along the waterfront.

Three things landlords should know:

1. The Congress St rebuild removes a major infrastructure objection for higher-density site plans downtown. Co-living and micro-unit projects on Maplewood Ave and Deer Street are targeting late-2026 groundbreaking.

2. NHMA is pushing to amend HB 631 before the July 1 effective date. If it passes, some commercially zoned parcels may lose their multifamily-by-right status. If it doesn't, the mandate stands.

3. NHPR reports that NH relies on property tax more than any other state: 61% of local government revenue. On a $500K property, the gap between Portsmouth ($11.51 rate) and Dover ($19.68) is about $4,100/year in carry cost.
