Easton Thompson Kasperek Shiffrin LLP - Criminal Defense Team ETKS is dedicated to providing the highest level of legal representation to clients who have been accused of crimes or who have been wrongfully convicted.

We represent clients accused of crimes in both federal and state court, including those charged with death penalty offenses in federal court. With over 120 years of collective experience, we focus our practice on serious and complex cases, including homicide and s*x offenses, drug offenses, weapon offenses, and white collar crime. However, we regularly represent clients across the spectrum of all

criminal matters, including those accused of misdemeanor and lesser offenses. We represent clients both at trial and on appeal, and we have substantial experience representing clients in state and federal postconviction proceedings, including Criminal Procedure Law Article 440 motions, motions for writs of error coram nobis, and petitions for writs of habeas corpus. We also represent clients who have been wrongfully imprisoned or convicted of crimes and whose civil rights were violated while incarcerated, both independently and in cooperation with Neufeld Scheck & Brustin, LLP, as well as clients whose liberty is at stake in involuntary commitment, Article 10, and S*x Offender Registration Act (SORA) proceedings. Brian Shiffrin and Bill Easton won a reversal by the Appellate Division, Fourth Department of an Onondaga County conviction for Criminal Possession of a Controlled Substance in the First Degree and an order suppressing evidence on a finding of two Miranda violations:

Brian Shiffrin obtained an order vacating a 1995 conviction for double murder for which the client had served 30 years on a sentence of 50 years to life.
The only forensic evidence purportedly linking him to the crime was a hair found in the hand of one of the murder victims which, based on the crime lab’s expert’s microscopic comparison, the prosecutor at trial urged matched the client's hair.
Brian brought a motion for DNA testing of the hair. The test excluded the client as a source of the hair.
The District Attorney and the Court agreed to set aside the murder conviction and sentence with the client agreeing to enter a plea to manslaughter, without making any factual admissions, since he continues to profess his innocence.
And now, after 30 years of incarceration, the client is home with his wife.

Easton Thompson Kasperek Shiffrin LLP (ETKS), a law firm founded in 2007 with a practice concentrated in criminal defense, wrongful convictions, exonerations, civil rights litigation, and family and matrimonial law, is pleased to announce the expansion of the firm with the addition of a new associate attorney, Benjamin Wittwer.

Mr. Wittwer received his law degree from the Washington University School of Law. He received his undergraduate degree from the University of Rochester.

Immediately prior to joining ETKS, Mr. Wittwer served as the Deputy Executive Director/General Counsel Deputy Executive Director and General Counsel of the Rochester Police Accountability Board (PAB).

Before moving to Rochester to work at the PAB, Mr. Wittwer spent over a decade as a public defender in Boston and Brooklyn, and was a Court Attorney in Kings County He has experience and expertise in criminal defense, capital defense, civil rights litigation, equitable policing, and administrative law,

Mr. Wittwer is licensed to practice in the State of New York and the Commonwealth of Massachusetts.
