So… we can’t agree in family court. Now what?! 😳

You’ve been going back and forth, and there are still things you haven’t been able to agree on.

Then you hear the words “trial-setting conference.” 👀
But what exactly does that mean?

In California family law, a trial-setting conference generally involves the court discussing scheduling and other matters related to a possible trial.

And here’s something people may not realize: A trial-setting conference is not the actual trial.

Depending on the court and the type of case, the discussion may include how much time a trial could take, scheduling, and other procedural matters.

Not every family law case follows the same process, and procedures may vary by county.

Here’s something a lot of people don’t realize! 👀

In California, ongoing child support and unpaid child support are two different things.

Child support generally ends when a child turns 18. However, if the child is still attending high school full-time and cannot support themselves, support may continue until graduation or age 19, whichever comes first. Other exceptions may apply.

But what about child support that was never paid?

That unpaid balance is called child support arrears.

And just because a child turns 18, or ongoing child support ends, doesn’t mean that unpaid balance automatically disappears.
Past-due child support may still be collected even after the child becomes an adult.

Yes, that’s actually a thing!

In California, there’s a process called income withholding, commonly known as wage garnishment.

Basically, an Income Withholding Order tells an employer how much support to take from someone’s paycheck and where to send the payment.

This can apply to child support and certain spousal support orders, depending on the circumstances.

But what if they’re self-employed? The process may look different since not everyone receives a regular paycheck from an employer.

A little recap of my LDA conference weekend! 📚✨

Such a great weekend learning, making connections, and being surrounded by people who share the same passion for helping others. If there’s one thing this weekend reminded me of, it’s how much the work we do really matters. There are so many people in our communities who need help, and seeing how valued and appreciated our services are means a lot.

I’ve always been someone who loves to learn and grow. I truly believe the more I learn, the more I can help others, and that’s something I’ll always make time for. So grateful for this experience, the people I met, and all the knowledge I get to bring back to my clients.

So, what does an LDA actually do? 👀

A Legal Document Assistant helps people who are handling their own legal matter with their legal paperwork.

The easiest way I like to explain it is:
You make the decisions. I help with the paperwork. 🤍
You provide the information and direction, and I assist with preparing your legal documents and filing them with the court.
And just because I can’t give legal advice doesn’t mean I can’t provide general information.

I can provide general, published information to help you better understand the process. I provide the general information, you make your own decisions, and I prepare the paperwork at your direction.

And just because I can’t represent you in court doesn’t mean you have to prepare all of your court paperwork by yourself.

If you’re representing yourself, I can assist with preparing your court documents at your direction before your hearing. You represent yourself in court. I help with the paperwork. 🤍

So if you’re handling your own legal matter and could use help with the document preparation side of the process, that’s where an LDA can help.

When I decided to go all in on becoming an LDA and building this on my own, it was a risk I knew I had to take.

Not everyone understood the path I was choosing. I heard different opinions and different perspectives, and I know a lot of it came from people wanting the best for me. But if I would’ve let those outside voices become my own, I wouldn’t be where I am today.
I knew when I started this that I wanted to build a life where I felt like what I did every day had purpose. I wanted to help people. I wanted my work to mean something.

Taking that risk wasn’t easy, but it was worth it. I’m grateful I trusted myself enough to take the chance. 🤍
