In general, getting a job with a DUI conviction depends on the employer. A job that requires driving is going to be more difficult to get due to insurance issues, meaning that the employer’s insurance company may not want to insure someone with a DUI conviction.

A DUI conviction, or even a wet reckless may negatively impact one’s career, particularly if the offender holds a commercial driver’s license(CDL) or is required to drive as part of his or her job.

Having a DUI conviction can bring many changes in your life style . These changes may include your ability to rent a car.

Often, with a DUI conviction comes a driver license suspension and restricted license thereafter. If your driver license is restricted such that you can only drive a car that is equipped with an Ignition Interlock Device (IID), you will very likely not be able to rent a car until the IID restriction is lifted.

Also, it goes without saying that you will need a valid driver’s license to rent a car, regardless of your driving record. Having a restricted suspended driver license, which many drivers with recent DUIs have, will keep you from renting a car.

In addition, rental car companies often run a driving record check on you before allowing you to rent a car. Most companies that run driving record reports will not allow you to rent a car within 48 months of getting a DUI.

In California, it’s a crime to operate a vehicle while “under the influence” of alcohol or drugs or with a blood alcohol concentration (BAC) of .08% or more.

Generally, California law provides sentencing guidelines for drivers convicted of a DUI. In other words, there’s a range of penalties that a judge can impose for a DUI conviction.

The allowable range is determined by a variety of circumstances, including:
defendant’s record, and the particular facts of the current offense.

Within the applicable range, judges use “mitigating” and “aggravating” factors to determine an appropriate sentence.

Aggravating factors are circumstances that essentially make the DUI worse. Aggravating factors increase the severity of a criminal act or the defendant’s culpability and warrant a harsher sentence.

Typical aggravating factors for DUI cases include:

prior convictions,
high blood alcohol levels,
reckless driving,
excessive speeding,
having a suspended license,
causing injuries or property damage,
and having a child in the vehicle at the time of the offense.
extensive criminal record for other offenses can dissuade a judge or prosecutor from being lenient.

Ma*****na/Drug DUI

Recreational use of ma*****na became legal under California law on January 1, 2018. However, driving "under the influence" of ma*****na is still illegal (Vehicle Code 23152(f)).

With the passage of Assembly Bill 64 (Prop 64), adults in California can now buy ma*****na legally for recreational purposes. Law enforcement believes that "stoned driving" is going to become more of a problem on California roadways because of the legalization of recreational ma*****na. Accordingly, law enforcement is very likely to devote even more resources and energy to enforcing California's ma*****na DUI laws.

Ma*****na is now a lot like alcohol in the sense that, although they are both legal to use, you can't drive while "under the influence" of either. You may be found guilty of a ma*****na DUI if you drive a motor vehicle while your "mental abilities" are impaired by ma*****na to the extent that you are unable to drive with the caution of a sober person using ordinary care.
