Mississippi’s custody laws have changed.

Under current Mississippi law, there is now a rebuttable presumption that joint custody is in a child’s best interest. That doesn’t mean every family will end up with the same parenting schedule—or that joint custody automatically means a 50/50 split.

Custody decisions still depend on the circumstances of each family and, ultimately, what serves the best interests of the child. Courts consider factors such as each parent’s relationship with the child, parenting abilities, stability, work responsibilities, the child’s needs, and other circumstances that may affect the child’s well-being.

For parents, that means it’s worth understanding the process before conflict and emotion begin driving decisions.
