Successor Trustees : Don’t Let a "Minor" Detail Stop Progress. 🛑
When managing a trust after a loved one passes, progress often depends on signed consents. A successor trustee may need beneficiary sign-off to sell property, move funds, or finalize a trustee accounting.
But if a beneficiary is a minor or lacks capacity, the process traditionally required court involvement to appoint a Guardian Ad Litem (GAL).
California AB 565 helps simplify that paperwork path through Virtual Representation. In many situations, a parent or another beneficiary with a substantially identical interest can sign administrative consents (keeping administration moving and avoiding the added expense of a court-appointed guardian).
