TRUE or FALSE: A company can charge you upfront fees to help modify your mortgage. 🤔

❌ FALSE.

Under California law, it's generally illegal for anyone to collect fees for loan modification or foreclosure relief services before they've fully performed every service they promised.

Watch for these red flags 🚩
• Pressure to pay before any work is done
• Promises of "guaranteed" approval
• Being told to stop paying or stop talking to your lender
• Asking you to sign over your deed

If you paid upfront fees or think you've been the target of a loan modification scam, Ace California Law can help you understand your options.

🏡 Know Your Rights: Is your home protected from creditors?

If you're facing a judgment, a lawsuit or unexpected debt, it's natural to worry about your home. The good news: California's homestead exemption protects a portion of the equity in your primary residence.

Here's the short version:
✔️ The protected amount ranges from $300,000 to $600,000, based on the median home price in your county
✔️ It's adjusted each year for inflation
✔️ It generally applies to the home you actually live in

What it doesn't do: it won't shield you from your mortgage lender, property tax liens or certain other secured debts.

Every situation is different. If you want to understand how much of your home is protected, Ace California Law is here to help.

📖 Legal Term of the Week: Lis Pendens

Pronounced "lees PEN-dens," it's Latin for "a suit pending."

In California, a lis pendens (also called a notice of pending action) is recorded with the county when a lawsuit involves a claim to real property, like a claim to title or possession. Once it's recorded, anyone looking to buy or lend on that property is on notice of the dispute.

Why it matters:
🏠 Buyers and lenders often walk away from a property with a lis pendens on title
⏳ It can put a sale or refinance on hold until the case is resolved
⚖️ If one was recorded improperly, the owner may be able to ask the court to remove (expunge) it

Seeing a lis pendens on your property, or thinking about recording one? Ace California Law can help you understand your options.

When a storm damages your home, the last thing you need is a denial letter from your insurance company. ⛈️🏠

You've paid your premiums on time, and now, when you need help most, you're told "no." It's frustrating and stressful, but it isn't always the final answer.

Insurance companies don't always get it right the first time. Claims can be denied, delayed, or underpaid for reasons that may be worth challenging, and many homeowners don't realize they have the right to push back.

💬 Have you ever had to fight your insurance company over a claim? Share your experience below.

If your claim was denied or lowballed, Ace California Law can take a second look.

Found your dream home? 🏡 That's the fun part! But before you get the keys, there's some important "homework" to do.

Before closing, make sure you review key documents like the property's CC&Rs, title report, easements, and disclosures. These can tell you things like what you're allowed to build, who else has rights to use part of your property, and any known issues with the home.

A little reading now can save you a lot of stress (and money) later. 🙌
