I keep getting asked about "attorney-seated non-grantor irrevocable trusts" being pitched by outside promoters. Here's the version I've actually seen described to clients: the attorney signs on as grantor, and the client is named trustee, so the client keeps running the investments and distributions on assets that are, in every practical sense, still theirs.

That flip doesn't change who the IRS treats as the grantor, and putting the client in the trustee seat undoes the independence the pitch is selling anyway. I wrote up why the structure doesn't hold up and what to check before anyone signs.

A version of this question keeps coming up, always in roughly the same shape.
