Don't Throw Away Or Take Someone's Property

Having Power of Attorney does not automatically give you permission to take jewelry, furniture, important papers, family keepsakes or other property for yourself.

Don't sell, give away, destroy, or disregard property unless you actually have lawful authority to do so and the action is consistent with your duties.

Keep records. Keep receipts. Document important decisions.

If someone asks what happened to the property, you should be able to account for your actions.

Don’t Use A Power of Attorney To Shut Everyone Out!!
A POA may give one person decision- making authority, but it should never be treated as permission to manipulate, isolate, or exploit a vulnerable person.

A agent should maintain appropriate records and be prepared to demonstrate that decisions were made within the authority granted and for the principal's benefit.

Family members do not automatically have a right to approve every POA decision, But Secrecy does not Erase Accountability!

If questions arise, the POA document and applicable law- Not " Because I said so"determine the agent's authority.

Power of Attorney is a position of trust..
Treat it that way.

College Students Need A Plan Too
An 18 year old living at home or away at college is legally an adult. Parents should have a family conversation about who may receive medical information and who should speak for the student if the student cannot speak for themselves. A little planning can prevent confusion during a crisis.

HIPAA
Permission is Not the Same As Decision-Making Power

A written HIPAA authorization can allow doctors and hospitals to share specified health information with a parent. But permission to receive information does not automatically gives that parent authority to make medical decisions. If decisions- making authority is wanted, discuss a proper health care surrogate or health care power of attorney.

Don’t wait for the Emergency Room
The worst time to discover you can't get information you need is during an emergency. An adult child can choose a parent, both parents or another trusted adult to receive health information. Put the choice in writing while everyone is calm and able to understand the document.
