Presidential proclamations cannot override or amend regulations created through the Administrative Procedure Act (APA) process.
Why not?
Regulations under the APA are created by federal agencies, not the President directly.

Agencies must follow formal rulemaking procedures:
Public notice.
Comment period.
Justification.

A proclamation doesn’t go through this APA process.

So, When Can a Proclamation Have Legal Effect?

Only when:
Congress has delegated authority to the President (via statute).
The proclamation stays within the limits of that authority.

Example: Under 8 U.S. Code § 1182(f), the President can suspend entry of foreign nationals if deemed in the national interest.
President Trump used this authority for immigration restrictions via proclamation.
But — if a proclamation exceeds authority, it can be challenged in court and ruled invalid.

President Donald Trump signed a proclamation Friday that would move to extensively overhaul the H-1B visa program, requiring a $100,000 fee for applications in a bid to curb overuse.
