USCIS announced a new policy memo today that will grant ‘Adjustment of Status’ only in extraordinary circumstances.

The new policy states that aliens seeking adjustment of status must do so through consular processing at a U.S. consulate abroad. Officers are directed to consider all relevant factors and information on a case-by-case basis when determining whether an alien warrants this extraordinary form of relief.

Further stating that “Nonimmigrants, like students, temporary workers, or people on tourist visas, come to the U.S. for a short time and for a specific purpose. Our system is designed for them to leave when their visit is over. Their visit should not function as the first step in the Green Card process. Following the law allows the majority of these cases to be handled by the State Department at U.S. consular offices abroad and frees up limited USCIS resources to focus on processing other cases within its purview, including visas for victims of violent crime and human trafficking, naturalization applications, and other priorities. The law was written this way for a reason, and despite the fact that it has been ignored for years, following it will help make our system fairer and more efficient.”

Does a pending Asylum application give an applicant a legal status?

No, it does not confer legal immigration status on an applicant, but it does provide an authorized stay. Which means you are not considered unlawfully present in the U.S during this time.

A pending Asylum application allows you to remain in the U.S while your claim is pending, apply for an employment authorization document(EAD), and it protects you from deportation until your case is decided.

If your asylum application is granted, you immediately receive asylee status, and you are eligible to apply for an adjustment of status(green card) after being physically present in the U.S. for one year after your asylum was granted. If your Asylum is denied, you could face removal if you have no other status.
