On Personal Injury cases, you can run to one of those larger firms that advertises on buses....You will get a younger associate, in most cases, and they will look for early settlements that aren't necessarily going to help you much.

I had clients who tried to retain more than one of these firms, and they all turned it down. They didn't want to take a chance on imperfect facts.

They retained my office, and at the end of the day, we settled the case for $500,000.

Lawyer Tip... Don't use Cashier's Checks if you can help it. They are considered "money"..if you lose them its very hard to replace them, and you will need to post a bond to stop the payment on the check. What the bank is selling you actually protects them more than it protects you.

Lawyer Pro Tip No. 5 - If you are injured in an Auto Accident, DO NOT negotiate with an insurance company. The minute they write you a check you should consider it highly likely they owe you much more than they are paying you. They don't care about you and they won't help you. Get an attorney. Any competent attorney can get you medical care on a lien basis, and will represent you on a contingency basis.

PROBATE ..Many people are aware that a California Will must be signed by two witnesses to be valid. Many do not know that any document that actually proves the intent of your deceased loved one can actually be declared a Will. This is true, if and only if, you can prove by clear and convincing evidence that the document is intended to be the last will and testament of the decedent.

Whenever you sign for a corporation, the best practice is to print your capacity beneath your signature. For instance, "Vice President of Acme Corp." If a person comes to you for a corporation and purports to bind that corporation to a contract, they must sign in that capacity, otherwise your contract will be worthless against that corporation. It is also standard in California Real Estate for any large purchase, such as Real Estate, that you have a memo from that corporation stating when and where the corporation voted to authorize to bind that corporation. Think of it like this, you can't walk into McDonalds and ask an employee there to agree that McDonald's will buy your home for a million dollars, even though that person obviously works there. You need to see an authorization, or you basically have nothing,

My basic Trust and Will package is $1100. This will include other documents useful in your later years. You need a Trust to keep your property out of probate court, where the average fees are going to be around $10,000, for small estates. The Trust also protects you against lawsuits, especially if you sign it before you are sued.

Writing a "Will" is not the end of the story. There are many mistakes you can make on it, if you go the cheap route and use a notary. A notary, or paralegal, by law, by the way, is not allowed to give you legal advice. Many of the cases that I end up litigating in Court are cases that involved strip-mall notary public or paralegals who had no real idea what they were doing.
