Well, the legal business has certainly slowed down during the pandemic but I'm sure life has not. As I get older I become more and more aware of how important it is for my clients past present and future to have a good solid estate plan prepared. As I try to push myself to a semi-retired state, I've made a personal commitment that I will reach out to clients who need or want an estate plan prepared and help them get that set up for the future.

Well hello folks. Or should I say potential clients. I saw another great human oversight recently and I must say not for the first time.

Someone came through my door, a young couple and because of the difference in their respective wealth they wanted a prenuptial agreement. Their marriage is scheduled for this coming weekend. Some attorneys would wing it and sell them a prenup, but that would be a mistake for the attorney on the client. At a minimum prenuptial agreement needs to be drafted and submitted to both parties for review 7 or more days before it can be signed. further I had to explain to them that I could not represent them both. since each party has significant rights at stake, each party must have an independent attorney discuss the legal ramifications of the prenuptial agreement with them before they sign it.

The moral of this story. Plan ahead. give your attorney a fighting chance to protect you.

Another morning in the office.
Phone call after phone call lately of folks who need legal help URGENTLY but whose problem could have easily been handled months or years ago when they first started to ignore it hoping it would go away? Sad though when a simple consultation a year ago could have set them on a path to avoid the problem or could have given them the time to address it and get ahead of it with proper legal action.

Folks, if you have marriage trouble, custody or child support issues or Estate planning needs like a will or a trust, don't wait until it is an emergency. See your Lawyer ASAP for a confidential consultation. As I jokingly say "don't get your legal advice from A GUY you know". See an Attorney.

Well last week I saw another sadly disappointed potential client. She came to me with her "daddy's" will. It said right there " I leave my house, at ### Maple Street, to my daughter". Problem was that he no longer owned that house. It was sold a few years before his death and replaced by a much more expensive house whick he had to have help to buy. It was owned jointly with his girl friend and her parents as Joint Tenants. By operation of law that house went to girl friend and her folks at the moment of his death. What a mess for the daughter.

Did he know what would happen when he died??? DO YOU KNOW WHAT WILL HAPPEN TO YOUR ASSETS WHEN YOU ARE GONE. An hour with your attorney and you will know. Then talk to the attorney about what you can do.

Well another stressful day in the legal business. Had to speak to the oldest child of an old client who evidently told each child what they wanted to hear about his love and affection for them. Told them that he wanted them to have this or that when he died and even told them he had done a will and I would know about it.

Well he hadn't, and he died. Now there are several children from different mothers who all think they are entitled to "GET EVERYTHING". They aren't, they don't and the family will be left fractured and spiteful..

Folks, don't leave your family in a shambles. Sit with your Attorney and decide how you want things to be handled when you are gone and have that Attorney prepare the appropriate Will and or Trust package to accomplish your desired outcome.

It was a rough day yesterday. I met two people with a really messed up legal situation that would not have gone bad, if they had first sought legal advice and assistance. Folks, don't let legal issues get ahead of you. When you confront a legal situation, don't THINK YOU understand what to do. Seek help from a Lawyer FIRST, before things are really messed up.

Since we aren't getting any younger, it's probably time to check and see if you have a good estate plan. That means at least a will and probably a will and a living trust with other related documents.

We all tend to think "there's plenty of time" to do that later. Well, I was recently called to the hospital bed of an old client to do an emergency plan. We got something put together but that's no way to plan for your loved ones. your final days and hours shouldn't be spent with a lawyer at your bedside. that client was lucky that someone got me to the bedside in time to do at least a limited plan.

If you haven't made a plan for the disposition of your assets and debts when you're gone, please think about that now.

Well, as we all get older, having a good estate plan consisting of at least a Will and a Trust is looking more important. I was recently call to the bed side of an old client who was within days of death, to put together a hasty plan. That client was much younger than me and had just thought there was plenty of time for estate planning,,,LATER. There was no later.

If you do not have, AT LEAST, a Will, you really need to get busy with your plan.
