The California Department of Motor Vehicles (DMV) and the California Highway Patrol (CHP) announced a new joint pilot program to take drivers who are caught speeding more than 100 mph off California roads faster. The program, called Forwarded Actions for Speeding Tickets (FAST), automatically refers these law breakers to the DMV Driver Safety Branch. Driver Safety will review the incident and driver’s record to determine whether immediate action — such as suspending or revoking the driver’s license — is warranted. The DMV decision is independent of any judicial actions associated with the citation and does not depend on a conviction.

AB 1950 - goes into effect in 2021 limiting the length of probation the court can impose on a convicted criminal defendant. The new law caps all misdemeanor probation cases to 1 year and felonies to 2 years unless the substantive charge mandates a minimum requirement. (Examples - 3 years for spousal abuse, 4 years for child abuse.) This will certainly affect those currently on probation as well as those seeking to expunge their records.

I mailed a letter to a client in state prison marked legal mail only to learn it took 30 days to make it to my client. I filed a removal order to the same state prison and was told they never received the court order. I had to fax a certified copy and was told they need 3 weeks to transport an inmate. Our prisons should be held to the same standard as any other business or governmental entity.
