Thin trust or thick trust... which one do you have?

A “thin” trust may leave important questions unanswered, allowing default state laws to fill in the gaps. A “thick” trust takes a different approach by anticipating those questions and putting more detailed instructions directly into the document.

The goal isn’t simply to have more pages. It’s to make sure your trustee has clear instructions when important decisions need to be made.

So ask yourself: Who do you want writing the rules for your trust... you or the government?

PODCAST: Does a longer trust mean you’re overcomplicating your estate plan? 🤔

Not necessarily. In estate planning, it’s not about how short or long your trust is, it’s about what it actually says and what it leaves up to state law.

In this podcast episode, learn the difference between a “thin trust” and a “thick trust” and why the details can matter for your trustee, beneficiaries, and family.

We’ll cover trustee powers, special needs, mortgages, investments, changes in the law, and more.

🎧 Listen to the full episode to learn why a longer trust isn’t necessarily a bad thing and how the right details can provide greater clarity for your loved ones.

📜 Is the government helping write your trust?

You may have a carefully prepared revocable living trust, but what happens when your document doesn’t specifically address an important issue?

In those gaps, state law may step in and determine how certain matters are handled, meaning the rules affecting your estate may not be entirely the ones you chose.

Your trust should clearly reflect your wishes and intentions.

I always enjoy seeing how different gyms are laid out and designed. It’s interesting to see how each space has its own setup and feel.

Here’s a photo outside a gym in Hyannis, Massachusetts, from a recent trip.📍

Is a shorter revocable living trust always better? 🤔

Not necessarily. The real question is not how long your trust is, it’s what it says and what it leaves up to state law.

In this video, I explain the difference between a “thin trust” and a more detailed “thick trust,” and why those details can matter for your trustee, beneficiaries, and family.

We’ll cover trustee powers, special needs, mortgages, investments, changes in the law, and more.

What may seem like a quick solution could create Medicaid penalties, tax issues, exposure to creditors or lawsuits, and even family conflicts.

Medicaid planning isn’t simply about moving assets out of your name. Timing, your assets, health circumstances, care needs, family situation, and legal documents can all matter.

🏠 A deed is not a plan. A transfer is not a strategy.

A revocable trust can be valuable for avoiding probate and managing asset but it generally does not provide the same protection as a Medicaid asset protection trust.

I explain the difference and also explain why understanding the purpose of your trust matters when planning for long-term care.

It’s always great to give back to the community, and I put just as much heart into my volunteer work as I do into estate planning and Medicaid planning.

Here I am serving as the MC for the 11th Annual Triangle YP Civitan Club Cornament fundraiser benefiting Special Olympics, alongside my friend Abir. It was a great time for an even better cause!

Grateful to be part of it and to help support such a great organization.
