Jaime H. Davis, Attorney NC Board Certified Specialist in Family Law A Raleigh native, Jaime Humphries Davis joined Gailor Hunt Jenkins Davis & Taylor PLLC in 2001.

Jaime is a Board Certified Family Law Specialist and was named a Super Lawyers’ Rising Star in 2013, 2014, and 2015. Jaime formerly served as Chair of the Wake County Bar Association’s Poverty Issues Committee. She currently serves as an attorney volunteer for the UNC-CH Community Legal Project, and she is an active member of the Raleigh Chamber of Commerce. Jaime’s practice incorporates all areas of family law, with a concentration in complex equitable distribution and child custody matters, including relocation and interstate cases. Jaime also focuses on family law contracts, including Premarital, Postnuptial, and Separation and Property Settlement Agreements. Jaime is a member of our appellate advocacy group, and she is a Certified Parenting Coordinator. Jaime received both a Bachelor of Arts with distinction in political science and English, and her Juris Doctor from the University of North Carolina at Chapel Hill. As an undergraduate, Jaime received the James M. Johnston and Hugh Morson Memorial scholarships. While in law school, Jaime studied family law extensively, taking numerous classes regarding complex domestic cases. Jaime also worked as a research assistant for Professor Buckner F. Melton, Jr., and was acknowledged in his 2002 publication, “Aaron Burr: Conspiracy to Treason.” Jaime clerked for Clayton, Myrick, McClanahan & Coulter in Durham and Teague, Campbell, Dennis & Gorham in Raleigh. Jaime’s background in domestic law and research enables the firm to stay on the cutting edge of developments in family law. "Why doesn't she just leave?"

It's one of the most common questions when it comes to domestic violence situations, and it's also one of the least helpful. Leaving is often not a single moment but a process, and North Carolina advocates say it takes an average of seven tries. The time right after leaving can also be the most dangerous.

Support looks like believing someone, not rushing them, and knowing where to point them.

The legal piece of divorce is just one small part of the whole experience. During my 25 years as a divorce attorney, I've seen how much smoother the separation and divorce process goes when clients have the right team in their corner.

An attorney who's solidly on their side, of course, but also folks like a therapist trained in separation and family transition, a financial advisor who can help you enter your post-divorce money management era with confidence, and a community of people who have been through divorce, too, and can offer empathy and support.

Myth Busters: Mediation Edition

❌ Myth: If you agree to mediation, you will be settling for less than you deserve.

✅ Fact: Mediation isn't about giving up. It's about staying in control.

In many family law cases, mediation can lead to better, more practical outcomes than litigation. It is often faster, less expensive, and gives both parties more input into the result instead of leaving major decisions entirely in the hands of a judge.

That does not mean mediation is right for every case. Some situations truly require court involvement. But for many families, mediation is not the “weak” option. It is often the smart one.

The weather is finally starting to cool down a bit in Raleigh -- just in time for the official start of fall today!

Speaking of fall in North Carolina...did you know we have one of the longest fall foliage seasons in the world here in the Tar Heel State? Thanks to having both high mountain peaks as well as a coast at sea level, the fall color wave takes more than six weeks to travel all the way across our state. It starts in the Blue Ridge Mountains in early October and finally wraps up in the Piedmont (here in Raleigh included) in late November.

What a gift to live in a state that has so much autumnal beauty to enjoy for so long!

Separating fact from fiction when it comes to divorce in NC:

❌ Myth: You need your spouse's permission to file for divorce.
✅ Truth: You don't. North Carolina is a no-fault state. Your spouse's agreement isn't required to move forward with a split.

❌ Myth: You have to prove your spouse did something wrong.
✅ Truth: Nope. Most North Carolina divorces just require living separately for one year without a need to show fault.

❌ Myth: Moms automatically get custody.
✅ Truth: North Carolina law doesn't favor either parent based on gender. Instead, judges make custody decisions based on the best interests of the child(ren).

Divorce law in North Carolina is full of misconceptions. When in doubt, ask an experienced attorney...not the internet.

In North Carolina, you do not have to file paperwork to become legally separated. Generally, separation begins when spouses start living in separate residences and at least one of them intends the separation to be permanent.

And when it comes to retirement accounts, generally only the portion accumulated during the marriage and before the date of separation is considered marital property. Premarital contributions typically remain separate, although tracing contributions and calculating gains or losses can make the analysis more complicated.

Divorce law has more nuance than people often expect, and it is always worth talking to an attorney who knows the details inside and out.
