DHS has filed an answer regarding INITIAL DACA applications. The response was filed today, Septemeber 29, 2025. In it DHS states it is willing to grant Initial DACA and work permission for applicants that do not live in TEXAS. However DACA holders in TEXAS will no longer be eligible for work permits.

In July of this year the court ordered DHS to comply with adjudicating initial DACA cases, but has not done so to date. DHS has no officially stated that it will begin processing these applications. I look forward to getting some approvals!

I have been telling clients: I expect to see news within the next two months. This is what I was referring to! Now that the election is over Congress has the freedom to pass the things that they want but were too afraid to vote on before an election.

FAQ:
1 Wasnt something just changed with DACA? Not really. The final rule was theoretically implemetned, but the only thing that would have been different (approving initial DACAs) is still stayed by the Federal Court in TX. So nothing has changed in the last month, or year.

2-Why can't we have more than just DACA? Like help for parents or at least expand DACA to more young people? The reason that we cannot be too ambitions is because we still have to play the game to get ANYTHING at all! Even during the lame duck we need ten republican Senators.

3-Why do we need Republicans to help if we have a majority in both the House and Senate? Because the republicans now play a game where they use their power to refuse to allow a bill to even get voted on. See my previous post explaining "filibuster". Having a majority doesnt matter if we are never allowed to even vote.

4-How long will it take for a new law to pass? We could have a new law in less than two months and it probably will take another few months to be in effect

5- Will it include a path to residency? No way to know. Probably not. Maybe yes.

6- Will it include more people than current DACA? No way to know yet. Maybe.

7-Can we pass several bills and try them all? Probably not. In order to have a very very good chance of passing we need to choose exactly the best possible bill and attach it to a budget bill that needs to pass to keep the government running.

8- Will a new law mean that all the cases that were already filed and are pending for Initial DACAs can get approved? Probably not, but it is hard to guess. The new law will be a whole new process, so it may not be able to reach back and protect those old applications.

URGENT!!! DACA DECISION IN!! COURT RULES DACA UNLAWFUL. Nothing changes at this moment for clients

Basically the court ruled that the injunction remains in place for the moment. So all of the pending initial DACAs are in limbo, but we can contunue to file and get approvals for renewals.

Yes, the Final Rule for DACA under the newly released program goes into effect on October 31st, but the court said that the injunction still means that initial DACAs cannot be approved yet.

A federal appeals court largely upheld a district court ruling finding that the Obama-era Deferred Action for Childhood Arrivals program is unlawful but sent the case back to the lower court to decide the legality of a new rule fortifying the program.

I am getting a lot of questions about the immigration reform. Bottom line is: SOMETHING MAY HAPPEN, AND WE WILL KNOW SOON. The longer version is: the current proposal is for work permits for most immigrants in the US for at least the last ten years. It passec the HOUSE, but not the SENATE. So, no, we cannot apply yet. Some colleagues say it has no chance in the Senate. But Congress insiders are not so sure. I am always overly optimistic, so I recommend watching experts for their opinions, and it seems that while many parts of the over all bill (Build Back Better bill) are not expected to survive, the immigration portion does seem to have a chance. There will be many changes next week, and perhaps today. After those changes it goes back to the House again. The final result will be known within just a few weeks. Please TAKE ACTION and tell your Congresspeople that you support immigration benefits in the BBB bill!

Adding immigration reforms to the Build Back Better agenda has been a Democratic goal.

ANNOUNCEMENT: NEW DACA POLICY TO BE PUBLISHED TOMORROW

As I said in my last article the administration annouced last week that they would be publishing new rules for DACA so that they could comply with the court's order in Texas v United States and thereby allow new DACA applications to be approved. Previously they were holding back in hopes that they could use DACA kids as leverage to get comprehensive reform through Congress,

DHS Issues Notice of Proposed Rulemaking for DACA
The U.S. Department of Homeland Security (DHS) today announced a notice of proposed rulemaking (NPRM) that would preserve and fortify the Deferred Action for Childhood Arrivals (DACA) policy.

If finalized as proposed, this NPRM would codify the existing DACA policy with a few limited changes, including:

Modifying the existing filing process and fees for DACA by making the request for employment authorization on Form I-765, Application for Employment Authorization, optional and charging a fee of $85 for Form I-821D, Consideration of Deferred Action for Childhood Arrivals; the current cumulative fees for both a DACA request and optional employment authorization would remain $495, absent any separate fee increase for the Form I-765 generally;
Providing clarity in procedures for termination of DACA and employment authorization, including when DHS will provide an opportunity for the DACA recipient to respond before a DHS decision;
Providing clarity to DHS’s longstanding information sharing and use policy for information provided by DACA requestors; and
Reiterating our long-standing policy that a noncitizen who has been granted deferred action is considered “lawfully present” for certain public benefits and does not accrue “unlawful presence” for purposes of section 212(a)(9) of the Immigration and Nationality Act.
To Submit Comments
The NPRM allows for a 60-day public comment period that begins once published on Sept. 28 and closes on Nov. 29. You may submit comments through Regulations.gov under DHS Docket No. USCIS-2021-0006. Please follow the instructions for submitting comments. DHS may not review comments submitted in a manner other than the one listed above, including emails or letters sent to DHS or USCIS officials.

DHS welcomes public comments on the proposed rule, including legal and policy considerations, and suggestions for alternative approaches. We will review all properly submitted comments, consider them carefully, and draft responses before issuing a final rule.

Background
On June 15, 2012, DHS established the DACA policy. The policy directed USCIS to create a process under which DHS exercises prosecutorial discretion, on an individual case-by-case basis, by deferring action against certain individuals who came to the U.S. as children, meet other guidelines, and warrant a favorable exercise of discretion. Since that time, more than 825,000 people have received deferred action under this policy.

On Jan. 20, 2021, President Biden directed DHS, in consultation with the attorney general, to take all appropriate action to preserve and fortify DACA, consistent with applicable law. Consistent with the president’s direction and the secretary’s broad authorities to administer and enforce the immigration laws, DHS is proposing to issue a rule to preserve and fortify DACA.

Ok, friends. Remember how I kept saying that they are using Dreamers as bargaining chips? And that I guarantee that they will fix DACA if we can't pass the bill? Well even I couldn't predict it would be this fast. Last night they killed the bill and this morning they announced that they would fix DACA again.

The White House has completed its review of a proposed rule to preserve and beef up deportation protections for individuals brought to the U.S. as children, often called “dreamers.”
