A missed payment today can become a lost claim tomorrow.

In this legal alert, Smith Anderson attorneys Andrew Atkins and Braden Rose discuss a recent North Carolina Court of Appeals decision highlighting the importance of careful drafting in long-term contracts with recurring payment obligations.

The takeaway: Parties should make clear when payment defaults occur, whether each missed payment creates a separate claim, and how unpaid amounts may be recovered as they become due.

Culture shows up in the words people use to describe where they work, and at Smith Anderson, the three words our colleagues have used most often are caring, collaborative, and collegial.

That feedback is one reason we are especially grateful to share that Smith Anderson has been named one of the Best Places to Work by the Triangle Business Journal for the seventh consecutive year. This recognition comes on the heels of also being named one of Business North Carolina’s Best Employers, and we are thankful to everyone who helps make the firm a place where people want to work, contribute, and grow.

We had a great night at the Durham Bulls game with our summer associates. ⚾

From the suite, we cheered on the Bulls while also keeping an eye on Game 2 of the Stanley Cup Final in support of the Carolina Hurricanes. While the Bulls didn’t come away with the win, the Canes did—and the evening was a win for great conversation, team spirit, and time together outside the office.

Thank you to everyone who joined us for a fun night at the ballpark. Go Canes!

Legal Aid of North Carolina has been a special part of the Smith Anderson Community Fund story since 2007. During a recent firmwide event, Smith Anderson presented Legal Aid with a $50,000 gift in support of its work providing legal assistance to people across the state who need it most.

The support comes at an important time, as Legal Aid experienced significant cuts in year-over-year funding in 2025, resulting in difficult decisions that included closing multiple offices, primarily in rural communities, and reducing staff.

The event also welcomed Smith Anderson’s 2026 Summer Associate class and offered an early look at the firm’s commitment to service, community engagement, and pro bono work. Read more about the event, Legal Aid’s work, and the Community Fund’s continued impact: https://lnkd.in/e8nQ3SnV
