Rhode Island follows a pure comparative negligence system. That means an injured person may still be able to recover compensation even when they share some of the responsibility for an accident. Any recovery may then be reduced according to the percentage of fault assigned to that person.

For example, if another driver were considered 80% responsible and you were considered 20% responsible, your potential recovery could generally be reduced by your 20% share of fault.

That is one reason you should not automatically assume a claim is over simply because an insurance company or even another party says you were partly responsible.

Fault can depend on many factors, including:
