When does a whistleblower case expose fraud – and when is it just along for the payday?

Buttaci Leardi & Werner partner Paul Werner spoke with Law360 Healthcare Authority about the DOJ’s revised approach to the False Claims Act and why healthcare providers have particular reason to pay attention.

The updated Justice Manual directs government attorneys to exercise their authority to dismiss parasitic whistleblower suits and avoid pursuing cases based on violations of nonbinding guidance rather than federal law or regulations.

For an industry steeped in complex billing rules and layers of agency guidance, that distinction matters.

As Paul puts it, the changes are “as close to a healthcare-specific set of guidance as you can imagine without them explicitly stating so.”

His perspective comes from defending healthcare providers in False Claims Act investigations and litigation, where the line between a reimbursement dispute and a fraud allegation can become the entire fight.

For healthcare leaders, the takeaway is straightforward: understand what the rules actually require, what the guidance merely suggests, and how that distinction could shape your defense when the government comes calling.

Twenty-five years have passed since September 11, 2001, yet the significance of that day has not diminished with time.

For so many, it marked an indelible dividing line — a day after which life, and our understanding of the world around us, would never be quite the same.

Today, we honor the memory of those who were lost and hold close the families, friends and communities who continue to carry their loss.

We also recognize a generation that has grown up knowing September 11 only through the stories, photographs and memories entrusted to them by those who witnessed it.

As the years move forward, remembrance becomes something we share — a commitment to preserve the memory of those we lost and to ensure that the meaning of this day is never forgotten.

If the government pulled on one thread in your healthcare organization, where would it lead?

That’s the question litigator Paul Werner asks in the latest Fraud Files, a special series within Almost Clinical, the podcast powered by Buttaci Leardi & Werner.

The DOJ’s new National Fraud Enforcement Division has put healthcare squarely among its priorities.

But Paul argues that the bigger issue for healthcare organizations may be the government’s ability to connect what were once treated as separate areas of risk.

A billing irregularity could lead to questions about referral relationships.
Revenue could raise tax issues.
And both could bring greater scrutiny to executive oversight and corporate governance.

So Paul suggests a practical exercise: pick a high-volume service line and follow the thread yourself.

What would the government see if it examined the billing, revenue, referrals and oversight surrounding that service line?

When the government is connecting the dots, healthcare organizations should be doing the same.
