The New Jersey Supreme Court has appointed a panel of retired Superior Court Judges (on recall) to resolve cases affected by the court's decision in State v. Cassidy.

The panel of judges serving on recall will adjudicate driving while intoxicated (DWI) cases in which the Alcotest machines were not properly calibrated with the proper thermometer which is utilized to take breath samples from defendants.

In November, the court ruled that tests obtained from uncalibrated Alcotest machines would not constitute reliable evidence. More than 20,000 cases are effected by these unreliable tests. These cases may be dismissed based on the unreliable test results.

Today, the New Jersey Supreme Court found a provision of the state's hate crime law as an unconstitutional infringement of due process. Unlike any other bias-crime law in the country, New Jersey requires the victim to reasonably believe that he was the target of a bias crime.

UCIS will begin accepting visa applications for skilled workers on April 1 (H-1B). The cap is 65,000 visas with an additional 20,000 for those with graduate degrees. Last year, the cap was reached within the first five days after the initial filing date. The earliest date for applicants to start work is Oct 1.
