Getting paid has a first step, and most people skip it.

You finished the job. The invoice went out. Now nobody answers the phone.

Texas has a step here that is easy to miss. Before attorney's fees are on the table in a breach of contract case, the claim has to be presented to the other side, and thirty days have to pass without payment. TEX. CIV. PRAC. & REM. CODE § 38.002.

The statute says present it. It does not say the demand has to be a letter. But a letter, sent so you can prove it went out, is how you show a year from now that you did.

A phone call leaves nothing behind. A text is better than nothing and worse than a letter.

If you are sitting on an unpaid invoice, that is where to start.

No tiene que dar una declaración grabada hoy.

Después de un choque, el ajustador del otro lado suele llamar rápido y pedir grabarlo. Esa llamada no es un trámite y no es neutral. Es evidencia, tomada cuando uno todavía está adolorido y todavía está adivinando.

Usted puede decir que devuelve la llamada. Puede averiguar primero qué exige su propia póliza, que es una pregunta distinta a lo que quiere la aseguradora del otro conductor.

Eso nadie se lo va a decir en la llamada.

You do not have to give a recorded statement today.

After a wreck the other side's adjuster often calls early and asks to record you. That call is not a formality and it is not neutral. It is evidence, taken while you are still sore and still guessing.

You are allowed to say you will call back. You are allowed to find out what your own policy requires first, which is a different question from what the other driver's insurer wants.

Nobody is going to tell you that on the call.

Una mudanza suena como algo aparte del caso. No lo es. Las oficinas mandan avisos por correo, y un aviso que llega a la dirección vieja cuenta como entregado.

Actualice la dirección en cada caso abierto, no solo en uno. Y guarde el comprobante de que lo hizo, con la fecha.

Un apretón de manos también es un contrato.

En Texas, un acuerdo de palabra normalmente ya es un contrato. Eso sorprende a mucha gente. Y luego sorprende otra vez, cuando resulta que tener la razón y poder comprobarla son dos cosas distintas.

El papel no es un trámite. El papel es la prueba.

Cuando no hay nada firmado, el caso se arma con lo demás. Mensajes. Correos. La factura y lo que dice. El cambio que alguien apuntó a mano. Fotos del trabajo terminado con fecha. Quién más estaba ahí.

Si le deben por un trabajo, junte todo eso ahora, antes de que alguien empiece a borrar conversaciones.

A writing is not what makes it a contract. It is what makes it provable.

In Texas a handshake deal is usually already a contract. People are surprised by that, and then they are surprised again when it turns out that being right and being able to show it are two different problems.

The writing is not a formality. It is the proof.

So when there is no signed agreement, the file gets built out of everything else. Texts. Emails. The invoice and what it says. The change order somebody scribbled on. Photos of the finished work with dates on them. Who else was standing there.

If you are owed money on a job, start pulling that together now, before anybody starts deleting threads.

Anote la fecha en que avisó.

El día que le dijo al dueño que había una fuga. El día que le dijo al contratista que el trabajo quedó mal. El día que le dijo al ajustador que estaba lastimado.

Esa fecha pesa más de lo que uno cree, porque casi todo lo demás se cuenta a partir de ahí. Y es justo el dato que se borra más rápido de la memoria.

No hace falta un formulario. Una nota en el teléfono con la fecha, a quién le avisó y qué le dijo alcanza, siempre que la escriba ese mismo día y no la cambie después.
