Don’t Delay:
The Longer the Marriage - The Longer the Alimony

If you are serious about divorce, don’t delay. New York State statutory guidelines may increase the duration of maintenance, (also known as alimony), based on the length of the marriage.

Length of the Marriage v. % of the length of marriage
for which maintenance will be payable.

0 up to and including 15 years 15% - 30%
More than 15 up to and including 20 years 30% - 40%
More than 20 years 35% - 50%

Therefore, if a couple was married in 2010 and decided to get divorced in 2018, the more monied spouse may have to pay the lesser-monied spouse between: 1 year and 2 months and 2 years and 4 months for the 8-year marriage (15% - 30%).

If that same couple was married in 2002 and decided to get divorced in 2018 – a total of 16 years, then the maintenance duration would be between: 4 years and 9 months and 6 years and 4 months. (30%-40%).

And finally, if the couple were married for longer than 20 years, the maintenance duration would be between: 8 years and 0 months and 11 years and 5 months. (35%-50%).

One caveat however, the Court still has the final authority to decide how long maintenance will be paid. The Court considers 15 factors in in its analysis and may deviate from the schedule.
