On today’s date in 1963 the US Supreme Court in Gideon vs Wainwright ruled that the US Constitution requires courts to appoint attorneys to indigent defendants.

The case started with the arrest of Clarence Gideon for the burglary of a pool hall in Panama City, Beach. Mr. Gideon, unable to afford an attorney, was found guilty after representing himself at trial. Gideon’s request for a free attorney was denied.

While in prison the US Supreme Court agreed with Gideon. Gideon was given a new trial, but this time with court appointed counsel.

After only one hour of deliberation the jury found Gideon “not guilty”.

Attached below is a copy of his appeal to the Supreme Court of Florida.

A real nightmare.

In 1994, daycare workers Nancy Smith and Joseph Allen were convicted and sentenced to life in prison for abusing children. It was recently discovered that a parent coached their child to lie to “get paid”. The two were granted a new trial before the prosecutor apologized and dismissed both cases.

These were the words of Nancy Smith as she addressed her accusers, "That one day you will all answer for this. Not only did you make me a victim, you made my children victims. You took me away from them in the most crucial times of their lives."

Nancy Smith spent 15 years in prison and Joseph Allen a total of 23 years behind bars.
