Commenting in today’s Portland Press Herald story by Emily Allen about Chief Justice Stanfill’s recent concurrence that “the state must do better” with their repeated discovery violations. In the case I was commenting on, the William Bradbury matter, the police gave the prosecution 3,200 pages of phone analysis on the eve of trial. The prosecution said they didn’t know about the data. But that is not an excuse. In 1995, in the case of Kyle’s v. Whitley, the Supreme Court of the United States held that the prosecutor had the obligation to find favorable evidence to the defense and disclose it. And so, the state has had 31 years to read that opinion and clearly they have not. Or, and more likely, they simply will not follow the demands of that obligation. The constant refrain we hear from the state and the courts is that prosecutors do not have the resources to handle all this discovery. But I would like to remind every prosecutor that if you do not have the resources to provide your constitutionally obligated discovery to defendants, you simply should not charge them with a crime in the first place. As I said to Emily Allen for this piece, Maine is a repeat offender when it comes to discovery violations.
