A .14% BAC does not automatically mean a conviction.

In State v. D.D., Attorney Matthew B. Nichols successfully defended a client charged with Operating Under the Influence in Scarborough. Despite an Intoxilyzer result of .14%, the defense uncovered significant issues surrounding the reliability of the test and presented evidence that raised reasonable doubt about both the BAC result and alleged impairment.

Following a two-day jury trial, the jury returned a verdict of:

NOT GUILTY.

Attorney Nichols challenged the Intoxilyzer evidence by examining calibration procedures, potential interfering substances, and proper testing protocols. Through a thorough pre-trial administrative hearing and extensive trial preparation, the defense also developed additional evidence that supported the client's case.

This case demonstrates why an OUI charge should never be treated as an automatic conviction. The evidence matters, and a strong defense can make the difference.

Wonderful Review for a Wonderful Lawyer

I contacted Matthew in order to help me with a case where I was caught shoplifting. He not only charged me a reasonable price, but was quick to make contact with me and let me know what he could do for me. I am in school to be a teacher, and was very concerned about having such a bad choice affect my career. Matt was able to reassure me that such a juvenile choice was not going to stay on my record as far as he was concerned. I was scheduled for court on three separate occasions, and I was fortunate to not have to attend any of the hearings. Matt really took care of me. He was relatively good about answering emails, and was always available to talk on the phone when an appointment was made. He knew exactly what to do! My case was dropped completely, and I couldn’t be more lucky to have Matt perform such a task! QUESTION: If I am arrested for OUI, is the officer required to provide me with my Miranda rights?

ANSWER: The officer is not required to read you your Miranda rights unless two things have occurred. First, you must be under arrest. The roadside questioning and the conduct of field sobriety tests do not arise to the level of an arrest. Second, you must be subjected to interrogation. Interrogation does not include questions regarding your name and address. Furthermore, interrogation does not include questions from the officer regarding your understanding of the Implied Consent warnings or your willingness to submit to a chemical test (breath test, blood test, or urine test). Interrogation is any question that is designed to elicit an incriminating response.

During the course of OUI investigations, officers are trained not to ask questions that constitute interrogation prior to the administration of the breath test. Accordingly, officers will very rarely read you your Miranda rights prior to the administration of a chemical test. Following the provision of Miranda warnings, you need not answer any of the officer’s questions without a lawyer present. Your invocation of your Miranda rights (the right to remain silent, the right to counsel, etc.) is not admissible against you in any trial for operating under the influence. If the opportunity presents itself you should exercise this right without fear of adverse consequences.

A Review for Matt Nichols

I would recommend Matt to anyone who is in need of a DUI lawyer. This experience was not easy and Matt helped me through the entire process. Every step he was there to explain what I needed to do and why. Not only was this experience an awful one but it is extremely confusing and Matt was there to explain all steps, options and possible outcomes. Matt was also willing to meet on the weekend to accommodate my work schedule.

Not only was Matt great but his inside team, Joanne, was great too. She has worked in the system for years and if Matt was not around, she had the answers to all my questions. She is very knowledgeable and always followed up with me on appointments and forms I needed to send in.
