Another CLG summer camping trip is in the books.

Our team spent the weekend on Sand Island enjoying campfires, game nights, Office Olympics, swimming, a sunset boat ride, and lunch at the Klondike Tavern in St. Helens.

Taking time away from the office to connect, recharge, and enjoy each other's company is an important part of our culture. We're grateful for weekends like these and the opportunity to build the relationships that make Chenoweth Law Group such a great place to work.

Last month CLG obtained a $743,000 attorney fee award in a Marion County Circuit Court Case involving the ouster of a construction company's CEO. The case involved claims for shareholder oppression under ORS 60.952, breach of fiduciary duty, breach of contract, declaratory judgment, and unlawful employment retaliation and was tried to a jury and the court. The court awarded damages including a buyout of the CEO for fair value, for a total amount of approximately $12 million.

Thanks to the team for this important win. Bradley Crittenden did a great job on the briefing, as always, and Laura Salerno Owens was excellent as our attorney fees expert. The verdict is on appeal to the Oregon Court of Appeals, as is the attorney fee award.

Earlier this year, we marked the milestone with clients, friends, family, colleagues, referral partners, and the soulful tunes of the Blue Wave Band — a memorable evening spent with many of the people who have helped shape the firm over the years.

An attorney for the winery owners says the penalties may be among the largest in the U.S. tied to fake legal citations.

The New York Times reported on a recent decision in one of our cases. The U.S. District Court granted our motion for sanctions, imposing nearly $110,000 in monetary sanctions and dismissing the opposing party's $12.6 million claims with prejudice. We found citations in their briefs that were not citations to real cases or were citations to cases that did not stand for the points of law for which they were cited. Their briefs also contained numerous incorrect quotes from court opinions.

The decision addresses a disturbing and growing trend in the legal profession: lawyers filing AI-generated legal briefs without verifying the accuracy of the cases cited in those briefs. In this case, the plaintiffs' attorneys filed briefs drafted by one of their clients without verifying the content of the briefs. The client's role, and a failure by anyone to take accountability for fake citations contained in three briefs, justified the dismissal of the plaintiffs' claims.

Whether used by attorneys or clients, AI tools do not replace the duty to ensure that what is filed with the court is accurate, substantiated, and truthful. Courts are holding parties accountable when they fail to perform that duty.
