These are the first words of Justice Clarence Thomas's opinion in New York State Rifle & Pistol Assn., INC. v. BRUEN June of 2022:
"In District of Columbia v. Heller, 554 U. S. 570 (2008), and McDonald v. Chicago, 561 U. S. 742 (2010), we recognized that the Second and Fourteenth Amendments protect the right of an ordinary, law-abiding citizen to possess a handgun in the home for self-defense. In this case, petitioners and respondents agree that ordinary, law-abiding citizens have a similar right to carry handguns publicly for their self-defense. We too agree, and now hold, consistent with Heller and McDonald, that the Second and Fourteenth Amendments protect an individual’s right to carry a handgun for self-defense outside the home."

The US Supreme Court heard oral argument yesterday in a DUI breath test case with implications here in Florida. At issue is Minnesota’s law that makes it a crime to refuse a breath test if you are pulled over for DUI. Florida makes a second refusal a crime.

The Minnesota case at issue involves William Bernard, of South St. Paul, who in 2012 was charged in Dakota County for refusing to take a breath test. The case is unusual. First off, he was not in a car but on a boat ramp — with car keys in his hand — when he refused the sobriety test.

The defense argues that a search warrant is necessary because consent to a breath test is not voluntary when one is threatened with a crime for refusing, and thus a violation of ones' Fourth Amendment protection against unreasonable searches without a warrant.

The government argues that the burden of blowing is minimal and the reason for refusing to avoid conviction for DUI.

The Court's opinion is expected in June.

This is when bad law makes bad cases. The Illinois law makes no sense - it holds a person criminally liable if they cause a traffic crash injuring others if any amount of illegal substance is found in their system regardless of whether it is a cause or just an inactive metabolyte. The new judge acted correctly in reducing the sentence to probation.
