FLORIDA ALERT: New Deadlines for Florida Civil Rights Act Claims (Effective July 1, 2026)
On May 22, 2026, Governor DeSantis signed HB 1407, bringing long-awaited clarity to filing deadlines under the Florida Civil Rights Act (“FCRA”), particularly regarding when a claim is considered to “commence.”
Here’s what you need to know:
Starting July 1, 2026, FCRA claims must be filed within:
• 1 year after a “cause determination” by the Florida Commission on Human Relations (FCHR), OR
• 1 year after receiving a Notice of Right to Sue from the EEOC
Whichever comes first.
If neither agency issues a determination within 180 days:
• The deadline becomes 18 months from the date the charge was originally filed.
These changes create strict new timelines that can significantly impact an individual’s ability to bring a claim.
