August is National Make a Will Month, and this is a good time to clarify a document that often confuses clients: the pour-over will.
A pour-over will is designed to work alongside a trust, not in place of one.
Here's how it fits together:
-Your trust is named as the beneficiary of your will.
-If any assets are still titled in your individual name at your death (rather than already held in your trust), those assets go through probate first, and the pour-over will directs them to "pour over" into your trust.
-This is typically paired with a revocable trust, though it isn't limited to one.
The goal is straightforward: everything you own is ultimately consolidated into your trust, where it can be administered according to the terms you've set out, rather than through separate probate proceedings.
A pour-over will is often described as a safety net for a trust-based estate plan. It doesn't replace proper funding of your trust during your lifetime, but it helps ensure nothing falls through the cracks.
