Families ask me this a lot: who's even allowed to file this? In Florida, a wrongful-death claim isn't brought by whichever relative is handling funeral calls or the insurance adjuster. It's brought by the estate's personal representative, who isn't qualified to act until the court issues letters of administration.

That appointment isn't a formality. Until those letters come through, nobody has authority to sign anything tied to the claim, and the personal representative generally brings the action for the survivors and the estate.

What I see most often is families gathering pay stubs and notes about household support while that appointment is pending. Smart move. That groundwork can carry forward, since Florida's wrongful-death deadline generally runs two years from death, not from when probate finishes.

If you're not sure who should petition for that appointment, I'd like to look at it with you. Call me: 305-900-6657.

When someone dies in a truck crash, the family is left holding two legal claims that sound identical and aren't.

Florida's wrongful death claim belongs to the family left behind, a spouse, minor children, or parents, for what the loss costs them going forward. A survival claim is separate. It carries the case your loved one could have filed themselves, including the medical bills and the pain before they died. You generally have two years to file the wrongful death claim.

The person who could explain what happened isn't here to. So the truck's own records do the talking. Federal law makes carriers keep electronic logs for six months and accident and driver-qualification files for three years, but those clocks start the day of the crash.

If your family is weighing what a truck case looks like, our number is 305-900-6657.
The records carry the story your loved one can't tell.

Hurricane season pushes more trucks onto I-95 and the Turnpike than any other time of year. Generators, water, plywood, fuel—all of it needs to reach stores before the storm does.

Federal rules cap drivers at eleven hours of driving, fourteen hours on duty, and prohibit driving if more than eight cumulative hours have passed without at least a thirty-minute break. When a dispatcher needs one more stop before the storm hits, those limits are exactly what get pushed.

If a truck pushed too hard on a rushed schedule and something goes wrong, critical data tied to the engine control module may be overwritten almost immediately—or within a few minutes or miles of subsequent operation—and how fast varies significantly by system.

Before that data gets driven over by the next load, call us: 305-900-6657.

When a car hits another car, you're usually dealing with one insurance company and one driver's version of events. A crash with a commercial truck rarely stays that simple.

The driver behind the wheel is only one name on the list. Federal rules say the trucking company can't dodge responsibility by calling that driver an independent contractor. If the company leased the truck and put them on the road, the company is on the hook too.

Then there's the insurance. Trucking companies typically carry a primary liability policy that meets federal minimums, often stacked with excess or umbrella policies for higher limits. Each one is a separate negotiation, and each one changes what the case is actually worth.

If you're trying to figure out who besides the driver might be responsible, call us: 305-900-6657.

There's one letter I send before almost anything else in a truck case: a demand that the carrier stop its normal deletion cycle and hold onto everything tied to the crash. It goes to the trucking company, the insurer, and sometimes a vendor, usually within the first few days, because some of what's sitting inside that truck doesn't wait around for a lawsuit to get filed.

The dashcam worries me most. Continuous footage on the device itself often gets overwritten within 24 to 72 hours. Event-triggered footage usually gets uploaded to the carrier's cloud servers and kept for 30 to 90 days, depending on the vendor plan. Two different clocks, running on the same camera.

Driver logs are the opposite problem. Federal law requires carriers to keep those for six months, so that data usually isn't what I'm racing against. The video is.

The earlier in the case, the more options you have. Call us: 305-900-6657.

Your phone buzzes: 'Uber confirmed, driver 3 minutes away.' That sound means more than a ride arriving. It's the moment the insurance math shifts.

If your driver accepted the trip and is heading your way, or already has you in the car when the crash happens, Florida law requires the rideshare company to carry at least $1 million in primary liability coverage for injury and death. That coverage follows the app status, not the driver.

Turn the clock back a little and it flips. If the driver was only logged in, waiting for a request, their personal policy usually leads, with the rideshare company adding a smaller layer behind it. Some personal insurers exclude rideshare driving altogether, which can push that smaller policy back to the front.

What I tell rideshare passengers first: screenshot the ride details and driver info right away. Before you assume any policy pays automatically, call me: 305-900-6657.

We'll help you find out which one applies.

You left the client meeting early to beat the storm home. By the time you reached your usual intersection, the light was dead, and so was everyone's certainty about who had right of way.

Under Florida law, when all signals at an intersection are inoperative, every driver must stop before entering and yield to vehicles that would have had the right of way if the signals were working. If two drivers arrive at approximately the same time, the one on the left yields to the one on the right.

Proving that order is everything, and it gets harder once the tow trucks leave. The police report usually helps. It's typically posted online within about ten days and routinely includes the officer's diagram and narrative of what each driver said, though it's not the final say on fault.

What I tell people who call me afterward: don't give a recorded statement to any insurance company until you've talked through what happened with someone not working for the other side.

The adjuster calls the morning after the crash and wants your statement on the record, today, while it's fresh. You're sore but figure you're basically fine, so why not get it over with.

In Florida, you're not required to give a recorded statement to your own insurer unless your policy actually requires it. And even then, you have the right to talk to a lawyer first.

The timing is the trap. Whiplash and concussion symptoms often don't appear immediately. They can take days or even weeks to fully manifest. Say you feel fine on day one, and that early statement can later be used to argue your injury was never that serious. Holding off until a doctor has looked at you is one of the first things I tell people who call.

If you want to think it through before you pick up for the adjuster, call us at 305-900-6657. The statement is harder to fix once it's recorded.

You were headed to pick up your kid from school when the light at that intersection went dark and stayed dark.

Florida treats a dead signal like a four-way stop. Everyone stops, then goes in order of arrival. If two cars arrive together, the one on the left yields to the one on the right.

That order is exactly what gets argued about later, and the proof fades fast. Skid marks wear off. Debris gets swept up. Where the cars stopped matters most, right after the tow truck hauls them away.

Nearby traffic cameras and business systems run on their own clock. Footage can disappear in as little as 7 days, depending on the system, so you won't know which applies to your corner until you ask.

Photograph the scene before the tow truck and cleanup crew do it for you. If you want help chasing down that footage before it's gone, call me: 305-900-6657.

The scene only exists once.

Miami in September: the same puddle inside the grocery store doors every afternoon, tracked in off the sidewalk by everybody with a wet umbrella.

That repetition matters. Under Florida law, a customer who slips on water like that has to show the store actually knew about it, or that the water sat there long enough that they should have known. There's a second path too. If the problem happened with regularity, it was foreseeable, and that's where a mopping log or a cleaning schedule starts doing real work. Apartment lobbies aren't covered by that same law, but courts look for similar proof that management was on notice.

The photo that helps most is usually the one taken before somebody comes out with the mop, along with the name of whoever showed up first.

Write down the time you fell, then save my number: 305-900-6657.
